Simpson <br />State Engineer <br />We have received your request for comments on a requested second amendment to the <br />above referenced special use permit. The amendment seeks to increase the size of the pit and <br />batch plant areas of a gravel mining operation known as the Rich Pit. <br />This mine operates under the Division of Minerals and Geology permit no. hf-85-218. In <br />1985 the applicant applied for and was denied, file no. AD-11060, a well permit for the pit. The <br />well permit application was denied because the applicant did not have an approved source of <br />water to replace evaporations from the exposed ground water. In 1987 the applicant applied in <br />water court for a plan for augmentation to provide replacement water. That plan is still pending <br />in court and appears to be inadequate. <br />Excavation of the pit has resulted in ground water being exposed. Due to the fact that <br />the pit does not have a well permit it is considered to be an illegal well. Therefore, in our opinion <br />no actions should be allowed which would tend to increase the exposure of ground water in the <br />pit.
