Lang <br />Division Director <br />RE: Rich Pit (Permit No. M-85-218) Response to request by Pueblo <br />County Planning Department for Information on the Rich Pit <br />Dear Mr. Sturgeon: <br />As you requested I do in our conversation 12/1/95, I can confirm <br />that Southwest Ready Mix was issued a permit for the Rich Pit <br />(Permit No. M-85-218) by the Colorado Mined Land Reclamation Board <br />on April 14, 1996. According to Divison records, the permit is <br />valid and the status of the pit is Active. <br />If the company intends to add new acreage to the approved permit <br />area for the Rich Pit, they will probably have to submit an <br />amendment application to the Division of Minerals and Geology for <br />approval. <br />The amendment process for a 112 permit, such as that issued for the <br />Rich Pit, resembles the permitting process for a new application. <br />This process includes the publication of 4 advertisements of the <br />application in successive weeks in a local newspaper, the sending <br />of notices of the application to adjacent landowners, the filing a <br />copy of the amended application with the County Clerk or Recorder <br />for public review and provision for a public comment period. In the <br />event of an objection to the amendment application, the Mined Land <br />Reclamation Board itself, not the Division, must make the decision <br />on the application. <br />If you have any further questions, please contact me. <br />Sincerely, <br />~~ct. wt2.
