Regarding Lot 9 of the Rartman and Wilcox Subdivision, <br />should Nalco acquire said property from Frank Stringer, <br />then Nalco shall supply the Department of Planning and <br />Development with a copy of the deed within 30 days of <br />its acquisition. Should that sale not occur and should <br />Mr. Stringer sell that parcel to another party, Nalco <br />shall provide the Department of Planning and Development <br />with a statement (such as is found in Exhibit 4) from <br />the new owner approving the inclusion of Lot 9 in SUP <br />No. 596 within 30 days of said sale. <br />6. Special Use Permit No. 596 shall be placed on a one-year <br />review. <br />CONCEPTUAL MINING/RECLAMATION PLANS <br />To date, Nalco has not formalized plans to mine and reclaim lands <br />under SUP #596. Detailed plans are premature at this time <br />because of unknowns regarding permitting, and the market for <br />their product. Still, Earl Brubaker (Nalco) has made some <br />generalizations about the pro,Ject that can be the focus for <br />discussion. To paraphrase Mr. Brubaker, those statements are as <br />follows: <br />1. Nalco prefers to conduct the extraction, on-site <br />transport and processing operations on the north side of <br />the Arkansas, thereby minimizing the amount of material <br />to be moved across the river. To facilitate that goal, <br />Nalco proposes to reestablish the river's active channel <br />to locations along their south property line. <br />2. Nalco's gravel deposits extend to depths approximately <br />20 feet below the water table. Consequently, ponds and <br />small lakes will be formed by the mining process. An <br />estimated 50% of the 1,058 acres under SUP #596 may <br />ultimately become lakes or ponds. <br />3. Nalco prefers to restrict their truck and other <br />equipment traffic between the extraction site and <br />processing plant to on-site road ways. <br />MINED LAND RECLAMATION BOARD (MLRB) PERMITS <br />Nalco Ss currently operating Sts East Pueblo Pit under a Limited <br />Impact (110) Permit. Said permit restricts the total area of <br />disturbance to 9.92 acres. In order to expand that operation, <br />Nalco has applied for a Regular (112) Permit. That application <br />now involves 72 acres. The application was reviewed and approved <br />by the MLRB in April, 1986. That 112 permit may be expanded, <br />though an amendment process, to include the full area under SUP <br />#596. The amendment process will include an evaluation of the <br />
