Public hearings will be part of the process. The 112 <br />Permit will be Sssued once Valco posts an acceptable bond. <br />Regarding the formation of lakes, the MLRB has been staffed such <br />that hydrologic effects of gravel mining operations can be <br />studied in detail. Recent funding and staffing changes may <br />result in a diminishment of their ability to provide those <br />services. <br />The MLRB also considers impacts of a proposed mining operation <br />upon structures adjacent to the mine property. Specifically, CRS <br />34-32-115(4)(d) states that: <br />(4) The (MLRB) board shall grant a permit to an operator if <br />the application complies with the requirements of this <br />article and all applicable local, state, and federal <br />laws. The board shall not deny a permit, except for <br />one or more of the following reasons: <br />(d) The mining operation will adversely affect the <br />stability of any significant, valuable, and permanent <br />man-made structures located within two hundred feet of <br />the affected land, except where there is an agreement <br />between the operator and the persons having an Snterest <br />in the structure that damage to the structure is to be <br />compensated for by the operator. <br />This may have immediate importance regarding the relationship <br />between Valco and the owner and residents of Meadowbrook Mobile <br />Home Park. Likewise, it may gain importance as lands <br />surrounding SUP #596 are further developed. <br />404 PERMITS <br />River channels move as a result of natural processes, and the <br />Arkansas River is no exception. Maps and photographs of the <br />Arkansas reveal numerous abandoned river channels. Historically, <br />the Arkansas in the vicinity of SUP #596 has meandered back and <br />forth between a well defined south bank and a less well defined <br />north bank. The meander area Ss approximately 3/4 of a mile <br />wide. Still, whether the river changes its course naturally or <br />not, for man to legally effect such a change Sn the U.S., a 404 <br />permit must first be obtained from the U.S. Army Corps of <br />Engineers (COE). For Valco to implement their conceptual mining <br />plan, rechannelization of the Arkansas will have to take place in <br />three or four places. In each instance, the change will involve <br />
