-43- <br />On Map 14R2 Section D-Dl it is shown that for a portion of the main haul <br />road the operator proposes to build a log retaining structure. This is the <br />only place in the permit that such a structure is mentioned. The Division <br />requires more detail regarding this structure prior to its construction. <br />Therefore, prior to main haul road construction, Chimney Rock Coal company <br />will submit and have approved by the Division designs for the log retaining <br />structure. These designs will be accompanied by appropriate documentation to <br />demonstrate the adequacy of this structure and detail methods of construction, <br />maintenance and reclamation. <br />The proposed operations are in compliance with this section. <br />XI. Bonding -Rule 2.05.4(2)(b) <br />The reclamation cost sections of the permit application are found in Section <br />3.00 of Volume I, Exhibit 12R2 of Volume II, and on Maps 20R2 (Bond Map) and <br />21R2 (Bond Calculation Cross-Sections) of Volume of the approved permit <br />application. <br />The bond amount is based upon "worst case" conditions occurring in 1985 during <br />the initial box cut phase of mining. The total cost for reclaiming the <br />operation has been calculated by Perma Mining Corporation and the Division to <br />be $818,509.00. <br />With the posting of the bond for the Permit Revision No. 2 Area as calculated <br />by the Division, the proposed operation will be in compliance with the <br />requirements of this section. <br />XXII. Sealing of Drilled Holes and Underground Openings - Rules <br />2.05.4(2)(9) and 4.07 <br />Information on the sealing of exploration and mine holes is found on page <br />2.05-27 of the permit revision application. <br />The proposed operation is in compliance with the requirements of this section. <br />XXIII. Subsidence -Rules 2.05.6(6) and 4.20 <br />Since this is a surface mining operation, the requirements of the subsidence <br />sections are not applicable. For a discussion of subsidence due to auger <br />mining, see the next section (Section XXIV.) <br />XXIV. Special Categories of Mining Other Than AVF and Prime Farmland - <br />.26. 4.27. 4.28. and 4.29 <br />The only special category of mining which is applicable in the Permit Revision <br />No. 2 Area is angering. Tfie applicant does not propose concurrent surface and <br />underground mining, mountaintop removal operations, steep slope operations, <br />off-site processing or support facilities, or in-situ processing. <br />
