-42- <br />In the opinion of the Division this response is to vague. The operator must <br />more throughly describe the proposed placement of spoil mixing techniques <br />intended to be used. Therefore, the operator has committed to clarify the <br />intended coal fine deposition techniques proposed to be used in the backfilled <br />areas of the Deep Creek permit revision. The operator will difine the <br />"Mid-Level spoils deposition areas" proposed to receive the coal fines. A <br />cross-section drawing, indicating the proposed zones for coal fine placement, <br />will be prepared and submitted. The applicant will clarify its opinion that <br />"no possibility of spoil instability or ground water contamination due to the <br />fines" exists. Chimney Rock Coal Company will prepare and submit these <br />required materials within ninety (90) days after permit issuance. No coal <br />fines shall be deposited by Chimney Rock Coal Company within the Deep Creek <br />Permit Revision area until that activity has been approved by the Division, in <br />writing. <br />The proposed operation is in compliance with this section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities - <br />D~~i~~ 9 nc Z/O\ 9 nG Z/71 .tea n nn <br />The facilities are discussed in detail in Section 2.05.3 of the permit <br />revision application and shown on Map 11R2. Chimney Rock Coal Company will <br />continue to use some of the facilities approved as part of the original <br />permit, however, many of these facilities are scheduled to be reclaimed prior <br />to completion of mining in the Permit Revision No. 2 area. Facilities to be <br />constructed in the Permit Revision No. 2 area include: a coal storage area, <br />scale, shop, portable crusher, change trailer, diesel and gasoline fueling <br />stations, and mobile equipment and employee parking areas. <br />The proposed operation is in compliance with this section. <br />XX. Roads -Rules 2.05 and 4.03 <br />Information concerning roads, their construction, location, maintenance, and <br />reclamation within the permit application areas can be found in Section 2.05 <br />of the permit revision application and on Maps 11R2, 12R2 and 14R2. <br />There are two designated haul roads within the proposed permit revision area. <br />The main haul road is located along the western edge of the active pit and <br />runs south to the topsoil and overburden storage area. The second designated <br />haul road provides access to Highway 151 and a truck loop for the portable <br />crusher. This road runs southwest to the Revision No. 2 shop area, crossing <br />Deep Creek. Flows in Deep Creek will be conveyed by means of a culvert and <br />overflow Swale. Portions of both of the haul roads will be downgraded upon <br />reclamation to re-establish the San Juan National Forest access road. <br />Chimney Rock Coal Company will construct a temporary access road from the East <br />pit area to the Deep Creek area to allow the one-time movement of heavy <br />equipment across Highway 151. The road will be in existence a short time and <br />will be reclaimed immediately after equipment is moved to the Deep Creek Area. <br />
