Geology -Rules 2.04.5_and 2.04.6 (2 <br />The applicant has supplied a description of the geology of the permit and <br />adjacent areas in Sections 4.2 and 4.3 of volume I of the application. These <br />sections have been reviewed by the Division to determine conformance with the <br />Colorado Rules and Regulations. <br />The applicant has submitted geochemical and physical analyses of the roof, <br />floor and coal for the Cameo seam from the McClane Canyon Mine (Tables 2.1-4, <br />2.1-5 and 2.1-Sa, Volume I, McClane Canyon permit application ), roof and <br />floor analyses for the Cameo seam from the Munger Canyon Mine (Tables 4.2-1A <br />and 4.2-1B, Volume I, Munger Canyon permit application) and the composite roof <br />and floor analysis for the Upper Carbonera seam from the Munger Canyon Mine <br />(Table 4.2-1. Volume I, Munger Canyon permit application). No analyses were <br />submitted for the stratum through which rock slopes will be driven between the <br />Cameo and Upper Carbonera seams. <br />The geochemical analysis of the Upper Carbonera roof and floor strata (Table <br />4.2-1) does not contain all of the parameters required by the Division. Since <br />waste material from these rock strata will be deposited in the waste rock <br />site, an analysis of the remaining parameters must be completed and submitted <br />prior to driving the rock slopes to the Upper Carbonera seam. Therefore, the <br />following stipulation is required to find the applicant in compliance with <br />Rules 2.04.5 and 2.04.6: <br />Stioulation No. <br />SIX MONTHS PRIOR TO THE DRIVING OF ROCK SLOPES WITHIN THE MUNGER CANYON MINE <br />FROM THE CAMEO COAL SEAM TO THE UPPER CARBONERA COAL SEAM, THE APPLICANT MUST <br />SUBMIT GEOCHEMICAL AND PHYSICAL ANALYSES OF THE UPPER CARBONERA ROOF AND FLOOR <br />STRATA AND ALL INTERBURDEN STRATA BETWEEN THE CAMEO AND UPPER CARBONERA COAL <br />SEAMS WHICH WILL BE ENCOUNTERED IN THE ROCK SLOPES. <br />If these analyses indicate the presence of toxic or acid-forming materials, <br />the Division may require the waste pile to be covered with a suitable amount <br />of material, pursuant to Rule 4.14.3. <br />With the acceptance of the above stipulation, the operation is in compliance <br />with the requirement of this section. <br />V. Hydrologic Balance; Surface Water - Rules 2.04.5, 2.04.7, 2.05.3(4), <br />SURFACE WATER BASELINE INFORMATION AND MONITORING <br />The information provided dealing with surface water quality and quantity were <br />reviewed by the Division. This information can be found in Section 4.5 of <br />Volume I and Section 4.3 of Volume VI of the application. <br />
