-13- <br />Several concerns were raised by the Division and the Office of Surface Mining <br />(OSM) during the review of the cultural resources survey. The applicant was <br />asked to define the extent of the survey, explain sample selecting procedures <br />and supply a review of the areas historic development. The applicant <br />satisfactorily addressed these three items. <br />Two sites identified during the cultural resources survey are located within <br />the Munger Canyon Mine plan boundaries. Site 5GF742, a pictograph, is <br />recommended as being eligible for listing on the National Register of Historic <br />Places, while 5FG743, an old homestead, is not. The homestead is adjacent to <br />the haul road for the mine, with the pictograph further removed from the road <br />on the canyon wall. Neither site will be disturbed by the proposed <br />operation. Because of this, and since 5GF742 is not actually listed on the <br />National Re ister of Historic Places, a mitigation plan is not required (see <br />Rule 2.05/64)). <br />An additional cultural resource study was prepared for Salt Creek Mining <br />Company in 1983 by the Grand River Institute, entitled "Cultural Resources <br />Inventory of Several Proposed Roads and Storage Areas Associated with the <br />McClane and Munger Canyons Plan/Permit Areas in Garfield County, Colorado" <br />(GRI Project No. 8292). This study can be found in Appendix Is of Volume VI <br />of the application. The survey covered areas associated with the proposed <br />central facilities area permit revision. <br />Three prehistoric (5GF1147, 5GF741, and 5GF742) and three historic (5GF742, <br />5GF326, and 5GF879) sites were identified. Five sites fall within the project <br />boundaries (5GF1147, 5GF742, 5GF743, 5GF326, and 5GF879) and three (5GF147, <br />5GF742, and 5GF879) of the five sites are located on Federal lands <br />administered by the BLM. <br />The SHPO has concurred with the BLM that site 5GF741 will not be impacted by <br />the proposed project; that sites 5GF743, 5GF326, and 5GF879 are not eligible <br />for inclusion in the National Register of Historic Places and therefore <br />require no further work, and finally that sites5GF1147 and 5GF742 are eligible <br />for nomination to the NRHP. A mitigation plan for the two eligible sites has <br />been developed by the BLM and concurred with by the SHPO on April 11, 1984. <br />The applicant, as part of the special stipulations attached to BLM Lease <br />Agreement No. C-36791, has committed to performing mitigation measures for <br />archaeological sites 5GF1147 and 5GF742 in accordance with the approved <br />mitigation plan. Mitigation activities will be performed prior to <br />construction activity in the area and will be coordinated by and through the <br />BLM Grand Junction Resource Area Archaeologist. A copy of the approved BLM <br />Lease Agreement is included as Appendix GS-11 within the amended permit <br />application. <br />Pursuant to Rule 2.07.6(2) (e), the Division finds the applicant will not <br />adversely affect any publicly owned park or place listed on the National <br />Register of Historic Places. <br />The operation is in compliance with the requirements of this section. <br />
