The DMG has attached one new permit stipulation to this <br />permitting action and has carried-over two other <br />• stipulations that continue in force. These stipulations <br />are described in the State Permit section of this decision <br />document. <br />Twentymile Coal Company's proposal does not require any <br />special conditions to comply with Federal laws. <br />V. Review Process <br />The DMG reviewed the PAP under the Colorado State program, <br />the Federal lands program (30 CFR Chapter VII, <br />Subchapter D), and the Colorado cooperative agreement (30 <br />CFR §30 CFR 906.30). Pursuant to the Colorado State program <br />and the cooperative agreement, DMG approved the permit <br />revision on April 20, 1998. <br />The Office of Surface Mining Reclamation and Enforcement <br />(OSM) has consulted with other Federal agencies for <br />compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences are included in the <br />decision document. <br />The Bureau of Land Management (BLM) reviewed the <br />resource recovery and protection plan for compliance <br />• with the Mineral Leasing Act of 1920, as amended, and <br />43 CFR Part 3480. The BLM recommended approval of the <br />mining plan modification in a memorandum dated May 1, <br />1998. <br />The U.S. Fish and Wildlife Service provided its final <br />consultation comments under Section 7 of the Endangered <br />Species Act in a memorandum dated November 14, 1997. <br />The State Historic Preservation Officer (SHPO) <br />concurred with the proposed mining plan action in a <br />letter dated April 24, 1997. <br />The proposed area of mining plan approval is not unsuitable <br />for mining according to section 522 (b) of SMCRA. <br />The mining plan modification area is not on any Federal <br />lands within the boundaries of any national forest. <br />OSM's review of the proposed action did not identify any <br />issues that required resolution via the addition of special <br />stipulations to the mining plan approval. However, during <br />the last months of the review of the permit revision <br />application, DMG raised concerns about the effects of <br />• -4 <br />
