The DMG has attached one new permit stipulation to this permitting action and has carried-over two other • stipulations that continue in force. These stipulations are described in the State Permit section of this decision document. Twentymile Coal Company's proposal does not require any special conditions to comply with Federal laws. V. Review Process The DMG reviewed the PAP under the Colorado State program, the Federal lands program (30 CFR Chapter VII, Subchapter D), and the Colorado cooperative agreement (30 CFR §30 CFR 906.30). Pursuant to the Colorado State program and the cooperative agreement, DMG approved the permit revision on April 20, 1998. The Office of Surface Mining Reclamation and Enforcement (OSM) has consulted with other Federal agencies for compliance with the requirements of applicable Federal laws. Their comments and/or concurrences are included in the decision document. The Bureau of Land Management (BLM) reviewed the resource recovery and protection plan for compliance • with the Mineral Leasing Act of 1920, as amended, and 43 CFR Part 3480. The BLM recommended approval of the mining plan modification in a memorandum dated May 1, 1998. The U.S. Fish and Wildlife Service provided its final consultation comments under Section 7 of the Endangered Species Act in a memorandum dated November 14, 1997. The State Historic Preservation Officer (SHPO) concurred with the proposed mining plan action in a letter dated April 24, 1997. The proposed area of mining plan approval is not unsuitable for mining according to section 522 (b) of SMCRA. The mining plan modification area is not on any Federal lands within the boundaries of any national forest. OSM's review of the proposed action did not identify any issues that required resolution via the addition of special stipulations to the mining plan approval.
