Recommended Findings of Fact: <br />1. Subject to the design and operation specifications provided in the application <br />documents, it can be determined that the project will conform to the district design <br />standards of these Regulations; i.e., the mitigation standards established for gravel <br />mining operations in Section V. C. of the Montrose County Zoning Resolution. <br />2. Considering the design and operation specifications provided in the application <br />documents and the recommended conditions, it appears that the on-site and off-site <br />impacts have been or will be satisfactorily mitigated. <br />3. Considering the design and operation specifications provided in the application <br />documents and the recommended conditions, it can be determined that, the proposed <br />Special Use will promote the best interest of the general public's health, safety and <br />welfare as set by either federal, state, or county regulation. <br />4. The applicant has forwarded pertinent technical information that is needed to assess <br />the project and paid the applicable fees and review costs. <br />5. A noticed public hearing has been conducted at which sufficient public testimony, <br />staff analyses, and application review criteria were available for evaluation. <br />Recommended Conditions of Approval: <br />CONDITIONS PRECEDENT : (to be completed prior to operation of the Special Use) <br />1. Provide documentation to confirm that the Farmers Water Development Company has <br />agreed to the use of recycled tail water from the irrigated pasture on the property for <br />the purpose of aggregate washing. <br />2. Provide documentation that the Colorado Department of Public ,Health and <br />Environment has reviewed the proposed project amendment and (a) does not require a <br />Final Permit or CDPS General Petrnit Certification, or (b) does require a Final Permit <br />or CDPS General Permit Certification. <br />3. Provide documentation that the operations conducted on Saturdays will be in <br />conformance with the more restrictive noise standards established for Saturday gravel <br />mining operations [max. permissible noise level of 75 db(A)]. Ref. Title 25, Article <br />12, Sections 101-105, and 108, C.R.S. <br />4. Provide documentation that the Division of Minerals and Geology has reviewed the <br />proposed project amendment and (a) does not require a MLR Permit revision, or (b) <br />does require a MLR Permit revision. <br />CONDITIONS SUBSEQUENT: (to be complied with during the life of the project) <br />1. Provide conies of the approved CDPHE Fugitive Emissions Permit prior to the <br />operation of a concrete batch plant or an asphalt batch plant on the mine site. <br />4 <br />
