3. As concerns the request for ~~regate washing the Gravel Mining Mitigation <br />Standards are silent on the issue of aggregate washing. However, it may be <br />appropriate that the County confirm that the provider of the water (recycled tail <br />water from the irrigated pasture on the property) has agreed to such use in writing; <br />presumably the Farmers Water Development Company. A condition precedent has <br />been provided to address this item. <br />Also, it should be cor frmed that the waste water will be disposed of in conformance <br />with the Colorado Discharge Permit System (CDPS), if applicable. A condition <br />precedent has been provided to address this item. <br />4. As concerns the request for extended hours of operation for Saturdavsfrom 7:00 a. m. <br />to 5:00 p. m. pursuant to the Gravel Mining Mitigation Standards (§ V. C 4. c., <br />MCZR.), if located within thirteen-hundred and twenty feet (1320) of an <br />existing residence or an existing platted subdivision, gravel mining operations may be <br />extended to include Saturday operations from 7.00 a. m. to 6:00 p. m. where <br />conformance with the more restrictive established noise standards for Saturday <br />gravel mining operations has been demonstrated. Accordingly it appears that the <br />proposed extension of operating hours can be found consistent with the intent of the <br />County's Gravel Mining Mitigation Standards. A condition precedent has been <br />provided to address this item. <br />S. As concerns the current 112 Permit from the Colorado Division o~Minerals and <br />Geology, no documentation has been received to indicate whether or not a permit <br />revision is needed. A condition precedent {tas been provided to address this item. <br />Durinn the review and comment period response was received from the County <br />Engineer CDOT and San Miguel Power. <br />a) San Miguel Power had no comment other than to reiterate their requirement that the <br />operator provide a 20 foot diameter clearance from the base of their pole, then a 2.•1 <br />slope from that clearance. Also, the operator shall maintain a minimum vertical <br />clearance of 18'6" under the distribution line and a minimum vertical clearance of <br />27'3" under the transmission line. <br />bJ The Colorado Department of Transportation reiterated their concern that the access <br />onto State Highway 145 is inadequate and will require improvement to handle the <br />traffic generated by the mining operation (copy attached). The County Engineer <br />expressed similar concerns; emphasizing that the owner and/or operator of the Angie <br />Pit shall 6e responsible for the cost of any required improvements. <br />IN SUMMARY -Based on the information provided, Staff is reasonably persuaded that <br />the proposed amendments can meet the requirements of Section T! C. of the Montrose <br />County Zoning Resolution (Gravel Mining Mitigation Standards), and that the proposed <br />project, as amended, can be conducted in the best interests of the citizens of Montrose <br />County. Applicable frndings of fact and conditions of approval have been identified for <br />consideration by the Planning Commission, fit is determined that a recommendation of <br />APPROVAL will be forwarded to the Board of County Commissioners. <br />3 <br />
