Water Rights and Replacement - Rules 2.04.7(3), 2.05.6(3)(a)(iii), <br />7 n~ L/7\/~\ .tea ~ nC 1C <br />The permittee's surface water control plan does not call for the <br />permanent impoundment of water. Sediment ponds at the site are the only <br />structures that impound water, and then only in the event of <br />precipitation. In addition, all sediment ponds must be dewatered within <br />36 hours of a precipitation event. Water use at the site was limited to <br />dust suppression and domestic use. Domestic water is supplied by a <br />permitted domestic well located at the site. The well permit is being <br />transferred to the landowner, Mel Martinez during the first quarter of <br />1992. <br />The permittee has returned the right to the water used for dust <br />suppression through a written agreement with Mel Martinez. Mel Martinez <br />has an adjudicated water right to 8.5 cfs of the flow in Stollstelmer <br />Creek. <br />The existing and proposed operation is in compliance with the <br />requirements of this section. <br />VIII.
