Pit 4 <br />Reclamation of the Pit 4 disturbance area of approximately 136.8 acres was <br />recently completed with final backfilling, grading, topsoil replacement and <br />seeding in fall 1990. As documented by Appendix A, Evaluation of Postmining <br />Configuration Relative to AOC Requirements, the final topography of the Pit 4 <br />area is generally consistent with an AOC configuration. The only area of <br />variance from AOC is the sideslope immediately above Pond 4 which will be <br />regraded and reclaimed in conjunction with partial filling and establishment of <br />the final Pond 4 impoundment configuration. The subject area encompasses <br />2.8 acres of approximately 2 percent of the Pit 4 reclaimed area. Because of <br />it's proximity to Pond 4, the slope area cannot be reclaimed at this time without <br />eliminating or significantly reducing the size of the pond. As a very limited area <br />which will be reclaimed in conjunction with Pond 4 this area is negligible relative <br />to Pit 4 backfilling and the requested bond release. <br />Consistent with the specific requirements of Rule 3.03.1, Rockcastle has for Pit <br />4; <br />a) Successfully completed backfilling, regrading, and drainage control <br />in accordance with the approved reclamation plan (Phase 1 release) <br />Given effective compliance with all applicable criteria, Rockcastle respectfully <br />requests Phase I bond release for the Pit 4 area. <br />Pit 5 and 6 <br />The Pits 5 and 6 areas, which have disturbed a total of approximately 32.9 acres <br />(Pit 5 - 22.3 acres, Pit 6 - 10.6 acres), were reclaimed in 19&4 and 1985 <br />respectively. The CMLRD has agreed that the reclaimed topography of Pits 5 <br />and 6 is generally acceptable. In order to address CMLRD concerns relative to <br />5 <br />
