<br />long-term geotechnical and geomorphic stability of the non-ADC areas, <br />Rockcastle completed field inspections, evaluated areas of concern, and <br />recommended specific remediation measures. Rockcastle is currently working ,' <br />with the CMLRD to resolve specific details and implement remedial measures. ~~ <br />However, remediation will not significantly impact the existing reclaimed ~ <br />configuration. <br />Revegetation success for the Pit 5 and 6 areas was evaluated by 1MS in 1989 <br />and subsequently by IME in 1990. The CMLRD also completed an independent <br />revegetation success survey for Pit 5 in 1989. These evaluations, <br />corresponding to years 5 and 6 (Pit 5) and years 4 and 5 (Pit 6) of the <br />reclamation liability period, confirmed cover values consistent with regulatory <br />requirements for vegetative reestablishment. Effective vegetative <br />reestablishment for the Pits 5 and 6 areas is documented by Appendix B, <br />Vegetation Monitoring and Bond Release Evaluation. <br />Consistent with the specific requirements of Rule 3.03.1 and agreements with <br />the CMLRD, Rockcastle has for Pfts 5 and 6; <br />a) Successfully completed backfilling and regrading in accordance with <br />applicable agreements with the CMLRD (Phase I release) _ ~~tv' `' <br />b) Successfully reestablished vegetation in accordance with thf ero,~'' <br />approved reclamation plan (Phase II release) <br />Given effective compliance with all applicable criteria, Rockcastle respectfully <br />requests Phase I-II bond release for the Pits 5 and 6 areas. <br />6 <br />
