<br />Given effective compliance with all applicable criteria for final bond release, <br />Rockcastle respectfully requests Phase I-III bond release for the Pit 2 area. <br />P~ <br />The Pit 3 area, which resulted in disturbance of approximately 30.1 acres, was <br />reclaimed in 1980-1981. Backfilling and grading of Pit 3 resulted in a reclaimed <br />configuration consistent with regulatory requirements for reestablishment of <br />AOC. Restoration of AOC for the Pit 3 area is documented by Appendix A, <br />Evaluation of Postmining Configuration Relative to AOC Requirements. <br />Revegetation success for Pit 3 was evaluated in both 1989 (IMS) and 1990 <br />(IME) corresponding to years 8 and 9 of the reclamation liability period. <br />Revegetation success evaluations indicate adequate cover to meet regulatory <br />requirements for vegetative reestablishment as documented by Appendix B, <br />Vegetation Monitoring and Bond Release Evaluation. <br />Consistent with the speck requirements of Rule 3.03.1, Rockcastle has for Pit <br />3; <br />a) Successfully completed backfilling, regrading, and drainage control <br />in accordance with the approved reclamation plan (Phase I release) <br />b) Successfully reestablished vegetation in accordance with the <br />approved reclamation plan (Phase II release) <br />Given effective compliance with all applicable criteria, Rockcastle respectfully <br />requests Phase I-II bond release for the Pit 3 area. <br />4 <br />
