<br />AOC as documented by Appendix A, Evaluation of Postmining Configuration <br />Relative to AOC Requirements. <br />Vegetation sampling and revegetation success evaluations were completed in <br />1989 by IMS and in 1990 by IME corresponding to years 9 and 10 of the <br />reclamation liability period. Revegetation success evaluations for the final two <br />years of the reclamation liability period confirm compliance with applicable cover <br />and production success criteria for the Pft 2 reclaimed area. <br />X ~n <br />V~ <br />The MLRD has waived the requirements for woody plant reestablishment <br />consistent with the stated desires of the surface owner and the designated <br />postmining land use. The waiver for woody plant reestablishment also has <br />direct implications relative to vegetative diversity requirements. Documentation <br />of revegetation success and a discussion of diversity considerations for Pit 2 is <br />provided in Appendix B, Vegetation Monitoring and Bond Release Evaluation. <br />Consistent with the specific requirements of Rule 3.03.1, Rockcastle has for Pit <br />2; <br />a) Successfully completed backfilling, regrading, and drainage conVOl <br />in accordance with the approved reclamation plan (Phase I release) <br />b) Successfully reestablished vegetation in accordance with the <br />approved reclamation plan (Phase II release) <br />c) Successfully completed all surface coal mining reclamation <br />operations in accordance with the approved reclamation plan and <br />agreements with the CMLRD including reestablishment of AOC, <br />compliance with revegetation success criteria, and completion of <br />the reclamation liability period (Phase III release) <br />3 <br />
