<br />Part 2b <br /> <br />Similarly to part 2a, the operator submitted information required to retain ponds 4 and 5/6 as <br />permanent impoundments as required by Rule 4.05.9(1). This information was received on <br />November 26, 1991 and May 13, 1992. As built certifications were received for ponds 4 <br />and 5/6 on November 20, 1992. The operator has complied with this part of the agreement. <br />IV -Engineering Studies <br />Part 1 <br />The operator submitted engineering studies on October 4, 1990 and February 6, 1991 <br />addressing stability of Pits 5 and 6. Map R-1 represents final post-mining topography for <br />Fits 5 and 6 and upland diversion ditches for these Pits were eliminated during the 1992 <br />reclamation work. No additional reclamation activities were required by the Division after <br />review of these studies. No unstable areas have been identified to date within Pits 5 and 6. <br />Therefore, the operator has complied with this portion of the agreement. <br />Part 2 <br />The operator identified those areas of the Pit 4 haul road where unstable sections exist. <br />Remedial activities consisting of buttressing and toe drains were installed in 1992 as per the <br />approved plan. Road drainage modifications are also complete. Rock material was imported <br />from offsite to complete these activities. The operator has complied with this part of the <br />agreement. <br />Part 3 <br />All culvert functions (with the exception of those along Grassy Creek) were eliminated <br />and/or replaced with open channel armored road crossings. Removal of these drainage <br />control features was done in accordance with the approved plan. All remaining and existing <br />
