<br />Part 4 <br /> <br />The shop building has been removed and the entire shop/yard area is topsoiled and reseeded. <br />Successful revegetation has been confirmed through field inspection. The operator has <br />complied with this part of the agreement. <br />Part 5 <br />The operator used their discretion for the sequence of reclamation activities. The operator <br />has complied with this part of the agreement. <br />Part 6 <br />For a variety of reasons, the operator did not complete reclamation activities by <br />November 20, 1990. However, with the exception of those activities noted in the summary <br />of this document, the operator has completed all required activities as of April 27, 1993. <br />Therefore, this part is superseded by this document and is no longer relevant. <br />III -Roads and Sediment Ponds <br />Part 1 <br />The Division received a letter from the landowner (Bogle Farms at that time) on <br />June 26, 1990 requesting retention of the pit access roads. Original width was maintained. <br />The operator is in compliance with this part of the agreement. <br />Part 2a <br />Appendix D submitted November 26, 1991 demonstrates compliance with Rule 4.05.2 for <br />Ponds 2 and 3. Additional Division concerns were adequately responded to on May 13, <br />1992. Therefore, the operator has complied with this part of the agreement. <br />
