<br />~~ <br />The operator did not submit information which demonstrates insufficient overburden material <br />to achieve approximate original contour (AOC) in Pit 4 because sufficient material was <br />available to achieve AOC. This was documented in an April 25, 1991 letter from the <br />Division to Rockcastle. Therefore, this part of the agreement is not relevant. <br />Part ld <br />The operator did not import fdl material for the purposes of backfilling pits 4, 5 or 6. The <br />operator has complied with this part of the agreement. <br />Part 2 <br />The operator submitted Appendix C on October 16, 1991 verifying topsoil depths established <br />on Pit 4. Mean topsoil replacement depth for Pit 4 was 21 inches. The operator has <br />complied with this part of the agreement. <br />Part 3 <br />The majority of Pit 4 was reseeded in 1989 using the approved seed mix, as indicated by <br />seed tags submitted by the operator on October 16, 1991. This seed mix is as outlined on <br />page IV-12 of the Grassy Gap permit with the exclusion of some of the trace species as <br />shown in the table and the inclusion of winter rye. Winter rye was added as a cover crop to <br />help control erosion until the other more permanent perennial species can become <br />established. <br />Qualitative evaluation during the summer of 1992 confirms that the perennial species have <br />become established over Pit 4, excluding the small area revegetated around Pond 4 in 1992. <br />Seed tags were submitted on November 20, 1992 for the remaining areas near Pond 4, which <br />were seeded in 1992. By fall of 1992, sprouting of winter rye was observed during site <br />inspections. Therefore, the operator has complied with this part of the agreement. <br />
