~'
Mr. Fred Banta
August 29, 1983
Page two
3. NUV 82-44 issued November 8, 1982 at the Twin Pines Mine was
vacated because of improper service, according to a January 19, 1983 letter
from Fred Banta to the operator. How was service of 82-44 improper, and
in what way did the nature of the violation and the company's effort to
mitigate the impact lead the Division not to pursue or reissue the violation?
4. NOV 82-64 issued November 19, 1982 at the Newlin Creek Mine was
vacated on January 20, 1983 because of confusion concerning who should have
"permitted the activities related to the drill holes in question". Does
MLRD have a policy concerning the applicable regulations in such situations,
and how was it applied in this situation?
5. NOV 82-67 issed November 26, 1982 at the Canadian Strip Mine was
vacated April 8, 1983. The principle reason, according to the letter, is
that "it was unclear whether the company was adequately controlling runoff
from the loadout". Could you further explain the source of this confusion
and whether or not runoff was adequately being controlled at the loadout
accordiny to CRR 4.05.1, 4.05.2?
Again, thank you,
Sincerely,
~~~.~
Carolyn R.
