-2- <br />Since permit renewal, mining has continued at approximately the rate projected <br />in the permit application package. The Seneca II Mine is active at this time <br />and reclamation has continued and kept pace with mine pit progression. <br />Two enforcement actions have been taken by the Division since permit renewal. <br />One Notice of Violation (NOY C-87-040), was issued October 7, 1967 for failure <br />to obtain a revision to the permit prior to constructing a haul road across a <br />reclaimed area. A minor revision was received at Division offices on October <br />13, 1987. The revision was complete and adequate and approved with conditions <br />on October 13, 1987, thus abating the NOV. The NOV was terminated on the same <br />day. A penalty of b250.00 was proposed on October 23, 1987 and a notice and <br />order to pay a fixed penalty was issued on November 10, 1987. The final <br />penalty of b250.00 was paid on November 27, 1987 which resolved the JJOV. The <br />second NOV (NOV C-89-024) was issued on September 28, 1989 for failure to <br />maintain adequate haul road culvert drainage. The culverts in question were <br />replaced by October 2, 1989. MLRD was notified of culvert replacement and <br />additional information related to the NOV was submitted by Peabody on <br />October 4, 1989, thus abating the NOY. The culverts were checked and the <br />violation terminated on October 19, 1989. A X750.00 penalty was proposed on <br />October 18, 1989 and the notice and order to pay a fixed penalty issued on <br />November 6, 1989. The final penalty of 5750.00 was paid on November 24, 1989 <br />which resolved the NOV. <br />Section II - Revisions to the Permit <br />Subsequent to permit renewal on September 23, 1986, Peabody has submitted and <br />obtained approval for ten minor revisions and eight technical revisions. <br />Minor Revision No. 24 was submitted on February 2, 1987 and reouested a <br />temporary change in mining sequence because of mechanical failure of the <br />Bucyrus-Erie 770B dragline boom. The revision was approved on <br />February 2, 1987. <br />Technical Revision PJO. 11 was submitted on February 6, 1987 and requested <br />further mining sequence chanoes because of dragline boom failure. Tne <br />revision was approved on June 22, 1987. <br />Minor Revision No. 25 was submitted on May 11, 1987 and requested approval of <br />a noxious weed control plan. The revision was approved on play 28, 1987. <br />Technical Revision No. 12 was submitted on April 8, 1937 and re guested <br />approval of proposed ~ diment Pond 008. The revision was approved on <br />June 5, 1987. <br />P1inor Revision No. 26 was submitted on Play 18, 1987 and requested a <br />modification to the spoil and topsoil monitoring plan. The revision was <br />approved on June 22, 1987. <br />Minor Revision JJo. 27 was submitted on August 11, 1987 and requested a 7709 <br />dragline deadhead route change in the Wadge Pit area. The revision was <br />approved on August 21, 1987. <br />Minor Revision No. 28 was submitted on October 13, 1987 and requested <br />relocation o` Haul P.oad .1 A. The revision was approved on Drtober 13, 1967. <br />
