Midterm Review <br />Seneca II Mine (~-80-005) <br />This document presents the results of the Division's Midterm Review of Peabody <br />Coal Company's Seneca II Mine. This Midterm Review was conducted to fulfill <br />the requirements of Rules 2.08.3, 2.06.2(10), 2.06.3(4), 2.06.5(3), 2.06.7(5), <br />and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its midterm (2-1 /2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revisions or modifications of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from approximate original contour <br />(AOC), and variances from contemporaneous reclamation, respectively, be <br />reviewed by the Division where applicable during the Midterm Review. The <br />Seneca II Mine does not have any experimental practices or any variances from <br />mountaintop removal, AOC, or from contemporaneous reclamation. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond every 2 1/2 years. <br />This midterm review consisted of a detailed review of the Seneca II Mine <br />permit application and findings document to identify any items that may have <br />been overlooked during the initial review. The Division also reviewed all <br />subsequent revisions and stipulation responses to ensure that all permit <br />commitments and conditions were being followed. Hydrologic monitoring data <br />was reviewed in conjunction with the review of the application to assess the <br />a de aunty of the monitoring plan and discussion of hydrologic impacts. <br />Problems and observations from past inspection reports were also considered. <br />Section I - History <br />Peabody Coal Company (Peabody) originally received an approved permit for the <br />Seneca II Mine on September 23, 1981. The permit was renevred on <br />September 23, 1986. The renewal process was completed and the proposed <br />Findings Document and decision to approve permit renewal issued on <br />December 31, 1986. The Division's decision to approve the Seneca II Iā¢iine <br />permit renewal was subject to six stipulations. Tne Division first published <br />the proposed decision to renew the permit on January- 8, 1987. No public <br />comment was received during the required 30 day comment period so the proposed <br />decision became final on February 7, 1987. Peabody submitted the required <br />56,431,188.00 corporate surety on February 20, 1987 and the permit renewal <br />became final. Tne new permit document erroneously reflected a permit <br />expiration date of February 17, 1992. However, Division policy dictates that <br />expiration dates remain the same as the originally issued Colorado State <br />permit. Replacement permit panes with the correct dates have been included <br />with this midterm review document. <br />
