Midterm Review Seneca II Mine (~-80-005) This document presents the results of the Division's Midterm Review of Peabody Coal Company's Seneca II Mine. This Midterm Review was conducted to fulfill the requirements of Rules 2.08.3, 2.06.2(10), 2.06.3(4), 2.06.5(3), 2.06.7(5), and 3.02.2(4). Rule 2.08.3 requires that the Division conduct a review of each permit issued, prior to its midterm (2-1 /2 years). Based on this review, for good cause shown, the Division may require reasonable revisions or modifications of the permit provisions to ensure compliance with the Act and Regulations. Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, mountaintop removal variances, variances from approximate original contour (AOC), and variances from contemporaneous reclamation, respectively, be reviewed by the Division where applicable during the Midterm Review. The Seneca II Mine does not have any experimental practices or any variances from mountaintop removal, AOC, or from contemporaneous reclamation. Rule 3.02.2(4) requires that the Division review the amount of the bond and the terms of acceptance of the bond every 2 1/2 years. This midterm review consisted of a detailed review of the Seneca II Mine permit application and findings document to identify any items that may have been overlooked during the initial review. The Division also reviewed all subsequent revisions and stipulation responses to ensure that all permit commitments and conditions were being followed. Hydrologic monitoring data was reviewed in conjunction with the review of the application to assess the a de aunty of the monitoring plan and discussion of hydrologic impacts. Problems and observations from past inspection reports were also considered. Section I - History Peabody Coal Company (Peabody) originally received an approved permit for the Seneca II Mine on September 23, 1981. The permit was renevred on September 23, 1986. The renewal process was completed and the proposed Findings Document and decision to approve permit renewal issued on December 31, 1986. The Division's decision to approve the Seneca II I•iine permit renewal was subject to six stipulations. Tne Division first published the proposed decision to renew the permit on January- 8, 1987. No public comment was received during the required 30 day comment period so the proposed decision became final on February 7, 1987. Peabody submitted the required 56,431,188.00 corporate surety on February 20, 1987 and the permit renewal became final. Tne new permit document erroneously reflected a permit expiration date of February 17, 1992. However, Division policy dictates that expiration dates remain the same as the originally issued Colorado State permit. Replacement permit panes with the correct dates have been included with this midterm review document.
