<br />•, THE PERMITTEE MUST MONITOR THE QUALITY OF WATER FLOWING IN WET CANYON <br />QUARTERLY. THE PERMITTEE SHALL PROVIDE AN AMENDMENT OF THE PROBABLE <br />HYDROLOGIC CONSEQUENCES OF SECONDARY OR RETREAT MINING ON THE QUANTITY <br />AND QUALITY OF SURFACE WATER IN WET CANYON. ALL MONITORING MUST CONTINUE <br />UNTIL DISCONTINUATION IS APPROVED BY THE DIVISION IN WRITING. <br />Stipulation No. 53 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER WET CANYON, THE PERMITTEE MUST <br />SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE TO MAKE FINDINGS THAT <br />SECONDARY OR RETREAT MINING UNDER THE CANYON WILL 1) NOT INTERRUPT, <br />DISCONTINUE OR PRECLUDE FARMING ON THE ALLUVIAL VALLEY FLOOR, 2) NOT <br />CAUSE MATERIAL DAMAGE TO THE QUANTITY OF GROUND WATER THAT SUPPLY THE <br />ALLUVIAL FLOOR, 3> PRESERVE THE ESSENTIAL HYDROLOGY FUNCTIONS OF THE <br />ALLUVIAL VALLEY FLOORS. <br />Section IV - Permit Updates <br />The following are items which need to be updated or revised in order to update <br />the permit document. Revised pages need to have the revision date on the <br />bottom of each page. The Table of Contents needs to be updated as well. <br />1. General Permit Information <br />A) Update permit revisions in Exhibit 27. <br />B) Update mine plan to include longwall mining, additional leased <br />acreage and disturbed and affected acreage throughout the permit, <br />such as: <br />1) Section 2.03.8, page 2.03-11, Permit Term Information, <br />2) Section 2.04.3, page 2.04-1, General Requirements, <br />3) Table 4, page 2.04-2, Acreage of Land Uses to be Affected, <br />4) Section 2.05.2, page 2.05-2, Operation Description, <br />5) Section 2.05.2(7), page 2.05-18, Coal Handling Structures. <br />C) Update Exhibit 21, Air Emissions Permits, if applicable. <br />D) Update Exhibit 23, Spill Prevention Control and Countermeasure <br />Plan, if applicable. <br />E) Update Exhibit 27, Technical/Minor Revision Approvals. <br />F) Please update any of the maps, if applicable. <br />2. Mining <br />A) Update the coal exploration information in Section 2.02 and in <br />Exhibit 2, Notice of Intent to Conduct Coal Exploration. <br />B) Update Section 2.04.6, Geology Description, to include pertinent <br />information on 3rd North Main, development and longwall mining, if <br />applicable. <br />-~- <br />
