-28- <br />XXIV. Soecial Categories of Minims - <br />Of these categories, only steep slope mining applies to the Coal Ridge <br />operation. Subsidence is possible in areas of the Grand Hogback where slopes <br />exceed 20 degrees. With resolution of the subsidence-related Stipulations, <br />the application is in compliance with the requirements of this section. <br />XXV. Miscellaneous Comoliance - Rules 2.03.3. 2.05.6(51. 4.02. 4.12. <br />4.19. 4.21. and 4.28 <br />The applicant has met requirements for format and supplemental information, <br />signs and markers, and slides and damage. No exploration activities are <br />planned at this time. The proposed coal loading facility west of Rifle, <br />Colorado is specifically not approved at this time. <br />The proposed operation is in compliance with the requirements of this section. <br />XXVI. Operations on Lands Sub.iect to Limitations or Prohibitions - <br />The Division finds that the operation is not included within an area <br />designated unsuitable for surface coal mining operations in an administrative <br />proceeding begun under Rule 7, or 30 CFR 769 of the federal Regulations. <br />The proposed operation is in compliance with the requirements of this section. <br />XXVII. <br />Can <br />Based on the information supplied in the application, the Division finds that, <br />in accordance with Rule 2.07.6(2)(b), the proposed mining and reclamation <br />activities can be feasibly accomplished. <br />The proposed operation is in compliance with the requirements of this section. <br />XXVIII. Compatibility With Anticioated_Ad.iacent Ooerations - <br />There are no existing or anticipated mines adjacent to the Coal Ridge No. 1 <br />Mine. Pursuant to Rule 2.07.6(2)(1), the Division finds that the proposed <br />operation will not be incompatible with other coal mining operations adjacent <br />to the proposed permit area. <br />The proposed operation is in compliance with the requirements of this section. <br />XXIX. Reclamation Fees Required by 30 C.F.R.. Chapter VII. Subchapter R - <br />The Division, through contacts with the U.S. Department of the Interior, <br />Office of Surface Mining, finds that New Castle Energy Corporation is current <br />with their payment of Reclamation Fees. <br />The operation is in compliance with the requirements of this section. <br />
