-z~- <br />XX. Roads - Rules 2.05.2(3) and 4.03 <br />Information on roads is contained in Section 4.2.4 of the application. Access <br />roads have been constructed to the surface facilities and to the portal pad <br />areas, as shown on Figure 4.2-3. 2,800 feet of the mine access/haul road is <br />proposed to be left after site reclamation at the request of the landowner, <br />NCEC. The roads meet the design standards of 4.03.1 (for haul roads as far as <br />the coal stockpile) and 4.03.2 (for access roads). The Division finds that <br />the retention of the road in the proposed reduced configuration is consistent <br />with the post-mining land use. <br />Stipulation No. 14 from the permit renewal is still in effect. This <br />stipulation addresses reclamation of light use exploration roads. <br />The proposed operation is in compliance with the requirements of this section. <br />XXI. Bondino - Rule 2.05.4(2)(b) <br />New Castle Energy Corporation has posted a performance bond in the form of <br />certificates of deposit totalling 5288,000.00, which the Division has <br />determined will be sufficient to cover the cost of reclamation at full mine <br />development. Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the Division finds <br />that the applicant is in compliance with applicable performance bond <br />requirements. Written documentation of the Division's reclamation cost <br />evaluation is available in the public files maintained at the Division offices. <br />The operation is in compliance with the requirements of this section. <br />XXII. <br />Designs for rock tunnel closure are shown in Figures 4.4-1 and 4.4-2, and well <br />abandonment methods discussed in Section 4.4.3.1. The closure and abandonment <br />designs are acceptable as proposed. <br />The proposed operation is in compliance with the requirements of this section. <br />XXIII. Subsidence - Rules 2.05.6(6) and 4.20 <br />The applicant has performed an investigation to identify renewable resource <br />lands which would be inspected by subsidence. The permittee demonstrated to <br />the Division that no material damage would occur to any of those identified. <br />Projections of ground subsidence made by the applicant have been previously <br />approved by the Division. Subsequent modifications to the mine plan consist <br />of reducing the undermined area. This modification would serve to lessen the <br />projections of subsidence. <br />The responses to earlier permit stipulations are given in Section 6.2 of the <br />application. The language of Stipulations 8, 9, 10 and 11 pertaining to <br />subsidence monitoring have been incorporated into this section, on pages 6-2 <br />and 6-3. <br />The proposed operation is in compliance with the requirements of this section. <br />
