i <br /> <br />the same as being in accordance with the provisions hereof. <br />In the event the Buyers shall notify Sellers of any defects <br />or encumbrances disclosed by said titla insurance conunitment <br />which, in Buyers' or Buyers' attorney's opinion, render <br />title to said property unmerchantable, Sellers shall Dave <br />until March 20, 1980, to remove or cause to be removed or <br />cured any such defects or encumbrances complained of and to <br />render title to said property acceptable to Buyers. In the <br />event Sellers are unable to cure the defects or encumbrances <br />complained of within such period of time, then the Buyers <br />may, at their election, either accept such title as Sellers <br />are able to convey or Buyers may elect to terminate this <br />Agreement and in the event of such termination, the Sellers, <br />upon receipt of written notice thereof, shall forthwith <br />refund to Buyers all sums paid hereunder, and neither of the <br />parties shall have any further obligation hereunder except <br />that the Buyers shall execute any documents necessary to <br />evidence the release of all their interest in said property. <br />5. Closing. The date of closing of this transaction <br />shall be ..April 20, 1980, or such earlier date as may be <br />mutually agreeable to the parties hereto. 'Phe closing of: <br />this transaction shall take place in the offices of Brooks, <br />Miller and Brooks, Attorneys at Law, NSontrose, Colorado. At <br />such time and place, the Sellers shall make, execute and <br />deliver to the Buyers a deed of general warranty conveying <br />title to all of the zeal property described in Paragraph lA <br />hereof to Buyers free and clear of all 1'iens and encumbrances, <br />except taxes for 1980, due in 1981; reservations and excep- <br />tions contained in United States Patent for said property; <br />and zoning, building code, subdivision and similar govern- <br />mental regulations regulating land use. <br />Sellers shall also at such time execute and deliver to <br />Buyers: <br />a. Sellers' bill of sale containing the t~:~ual <br />~r.~ covenants of warranty transferring title to all of the <br />r ` personal property described on Exhibit B annexed hereto <br />~I <br />-6- <br />
