-58- <br />XXII_. Special Categories of Mining Rules - 2.06, 4.22, 4.26, 4.27, 4.28 <br />and 4.29 <br />Blue Ribbon Coal Company has presented an application for a variance from <br />approximate original contour restoration requirements for steep slope min- <br />ing pursuant to Rule 2.06.5. The application detailing responses to all <br />applicable sections of Rule 2.06.5(2) can be found in Appendix 'D 'of the <br />permit application. A letter demonstrating approval by the U. S. Forest <br />Service, the surface Land owner, can be found on page 17 iv of the permit <br />application. Blue Ribbon Coal Company has committed to providing appropri- <br />ate geotechnical analysis and proposed restored slope configurations which <br />achieve a static safety factor of 1.3 pursuant to Rule 4.27.4(1). <br />Pursuant to Rule 2.06.5(2), the Division finds that the Blue Ribbon Coal <br />Company permit application has satisfactorily addressed all of the require- <br />ments for permitsincorporating variances from Approximate Original Contour <br />Restoration Requirements for Steep Slope Mining. <br />The application is in compliance with the requirements of this section. <br />XXIII. P9iscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.I9, 4.2I, <br />4.28 and 4.30 <br />Division inspection personnel have reported that perimeter markers satis- <br />fying the requirements of Rule 4.02.3 have been placed along the perimeter <br />of the surface affected area. The topsoil stockpile located at the <br />northern base of the mine bench has a marker which satisfies the require- <br />ments of Rule 4.02.7. <br />The applicant has committed to informing the Division immediately if land <br />slides occur at the mine site as required by Rule 4.12(2). The applicant <br />has also committed to performing remedial action on the mine bench embank- <br />ment which has shown tendencies for mass movement (see Appendix D of the <br />permit application). <br />A truck scale and small coal storage bin are located about four miles from <br />the mine site on Colorado Nighway I33. The applicant has satisfactorily <br />addressed all of the requirements of Rule 9.28 in regard to this facility. <br />The operation and reclamation plan for the truck scale facility can be <br />found on page 107 of the permit application. The sediment control system <br />is shown on Exhibit G'and supporting calculations are contained in Appendix <br />C of the permit application. The site location is shown on Exhibit O and <br />details of this facility are shown on Exhibit A' of the permit application. <br />The application is in compliance with the requirements of this section. <br /> <br />
