Operations on Lands Subject To Limitations Or Prohibitions - Rules <br />.2.03.7, 2.10 and 2.07:6 (2) <br />Both the Blue Ribbon Mine and the Truck Scale Facility Located adjacent to <br />State Highway 133 were in existence prior to August 3, 1977. These facili- <br />ties are, therefore, exempt from the requirements of Rules: 2.03.7 Relation- <br />ship to Areas Designated Unsuitable for Mining, 2.07.6(2)(d) and 2.07.6(2)(e). <br />Documentation demonstrating that these facilities were in existence as of <br />August 3, 1977 can be found in Exhibit I "Right of Entry and Operation <br />Information" of the permit application. <br />The application is in compliance with the requirements of this section. <br />XXV. L~monstra ti on That Surface Coal Mi Wino and Reclamation Onera ti on's <br />Can Be Feasible Accomolished - Rule 2.07.6(2 <br />The Division finds, as required by 2.07.6(2)(b) that the proposed mining <br />and reclamation activities as described in the application can be feasibly <br />accomplished. <br />The application is in compliance with the requirements of this section. <br />XXVI. Compatibility with Anticipated Adjacent Operations - Rule 2.07.6(2)(1) <br />The Blue Ribbon Mine is removing the'E'seam, or Bawk's Nest seam, of the <br />Paonia member of the Mesaverde Formation. Other operations [vi thin the <br />general area are the U. S. Steel Somerset Mine, the Colorado Westmoreland <br />In c.'s Orchard Valley Mine, the Western Slope Carbon In c.'s Hawk's Nest <br />Mine, the Bear Coal Company's Bear Mine and the Anaconda 14inerals' Mt. <br />Gunnison No. 1 Mine. The permitted and proposed operations of all of these <br />mines, except the U. S. Steel Somerset 19ine, are several miles distant from <br />the Blue Ribbon Pline operations. No problems due to the operation of the <br />Blue Ribbon Pline are expected within any of the more distant operations <br />within the general area. <br />The U. S. Steel Somerset Mine is mining the 'B-2' seam, approximately 450 feet <br />below the Blue Ribbon Kline. By agreement, U. S. Steel is precluding extraction <br />of additional coal beneath the Blue Ribbon Mine's underground workings, during <br />the life of the Blue Ribbon operation. Because there is a massive sandstone <br />member between the two affected seams, it is unlikely that the Blue Ribbon <br />Mine will affect operations within the Somerset Mine. <br />Pursuant to Rule 1.07.6(2)(1), the Division finds that the proposed operations <br />at the BZue Ribbon Mine will not be incompatible with other coal mining opera- <br />tions anticipated to be performed within areas adjacent to the proposed per- <br />mit area. The application is in compliance with the requirements of this <br />section. <br /> <br />
