Backfilling and Grading (con!t) <br />-56- <br />The post-mining topography map, Exhibit F, is adequate with one exception. <br />In the area of pond 1,Exhibit F indicates additional surface disturbance <br />from grading operations that could result in a loss of established riparian <br />vegetation. The area affected by the additional disturbance appears to be <br />less than 1 acre. The area is relatively small. The Division feels that <br />protection of riparian habitat is important and that manipulation of the <br />final contours on Exhibit F would limit the total area of disturbance and <br />protect the existing riparian vegetation. Therefore, the following <br />stipulation is imposed: <br />2. BLUE RIBBON COAL COMPANY SHALL REVISE EXHIBIT F OR OTHERWISE AMEND THE <br />PERMIT APPLICATION ~ ENSURE PROTECTION OF ESTABLISHED RIPARIAN VEGETATION <br />ADJACENT TO POND 1. A REVISED EXHIBIT F OR OTHER AMENDMENT DEMONSTRATING <br />PROTECTION OF THE RIPARIAN HABITAT MUST BE SUBMITTED TO THE DIVISION WITHIN <br />30 DAYS OF PERMIT ISSUANCE. <br />Blue Ribbon Coal Company has committed to performing appropriate geotechnical <br />analysis to demonstrate conformance with the stability requirement of the <br />4.14.2(1)(b) (see Appendix D). No date by which the work specified in <br />Appendix D of the application would be submitted to the Division is specified <br />and it is not clearly stated in the application that the proposed reclaimed <br />configuration of the haul road would be included in the analysis. In order <br />to assure timely completion of the required report and inclusion of the <br />proposed reclaimed configuration of the haul road in the analysis, the Division <br />imposes the following stipulation: <br />3. BLUE RIBBON COAL COMPANY SHALL PROVIDE AN ACCEPTABLE STABILITY ANALYSIS <br />OF THE PROPOSED BACKFILLED CONFIGURATION OF ALL MINE FACILITIES AND THE <br />HAUL ROAD, INCLUDING AN APPROPRIATE MATERIAL SHEAR STRENGTH TESTING <br />REPORT. THIS STABILITY ANALYSIS SHALL DEMONSTRATE COMPLIANCE WITH THE <br />STATIC S7APE SAFETY FACTOR REQUIR EAfENTS OF RULE 4.27.4(1). THIS ACCEPTABLE <br />STABILITY ANALYSIS SHALL BE SUBMITTED 10 THE DIVISION WITHIN 60 DAYS OF <br />PERMIT ISSUANCE. <br />Underground development waste generated at the Blue Ribbon Mine will be <br />hauled to the Red Canyon mine's permitted waste disposal pile site. Both <br />mines are currently managed by Western Associated Coal Corporation. <br />With the addition of the above stipulations the application is in compliance <br />with the requirements of this secfi;on. <br /> <br />
