-55- <br />Structues <br />is and Di <br />FIELD WORK, THE ABOVE-PIENTIONED PIAP, AND A REPORT DEFINING CORRECTIVE <br />MEASURES, IF SLOPE TREATMENT IS REQUIRED, SHALL BE SUBP4ITTED TO THE <br />DIVISION FOR APPROVAL WITHIN 30 DAYS OF PERMIT ISSUANCE. <br />The commitment to provide immediate removal of any mass-wasting debris <br />and the fact that all surface drainage below the haul road is treated <br />by the sediment control system satisfies the environmental protection <br />requirements of Rule 4.03.1(c)(i). Blue Ribbon Coal Company has provided <br />appropriate signage to ensure prevention of "harm to the public health <br />and safety" as required by Rule 4.03.1(3)(c)(i). <br />With the addition of the stipulation above, the application is in <br />compliance with the requirements of this section. <br />C) Ponds, Impoundments and Diversions. <br />The sediment and drainage control system provided by Blue Ribbon <br />Coal Company is designed to protect the quality of water in Hubbard <br />Creek. The system consists of three sediment control ponds, two <br />diversion ditches, a collection system for mine bench drainage, two <br />road~ci•ossing culverts and a collection ditch at the base of the mine <br />bench fill. <br />A description of the sediment and drainage control system is given <br />on pages 105-107 of the permit application. Detailed design information <br />is given in Appendix C. Drawings detailing the sediment control system <br />and the contributing drainage areas are Exhibits H and G respectively. <br />During the permit review process, problems were found in the designs <br />of pond outlets, culvert design methods and the determination of <br />contributing drainage areas to various sediment and drainage control <br />structures. All of the previously identified concerns regarding the <br />sediment and drainage control system have been satisfied. <br />The application is in compliance with the requirements of this section. <br />XyI. Explosives - Rules 2.05,3(6) and 9.08 <br />There are no explosives used at the Blue Ribbon Mine. <br />XVII. Backfilling and Grading - Rules 2.05.3(6), 2.05.3(9), 2.05.9(2)(a), <br />2.05.4(2)(c), 4.09, 4.13, and 4.14 <br />The mine bench material will provide the material necessary to backfill the <br />mine bench and haul road. Due to the steep slope nature and the tendency <br />towards instability, a variance of the approximate original contour restoration <br />requirements of Rule 4.19.1(2)(a) is appropriate under the provisions <br />of Rule 4.27.4. See Section XXZZ "Special Categories of Mining", page 58 <br />of this document for specific findings regarding this application. The <br />description of the reclamation plan including backfilling and grading <br />begins on page lOB of the permit application. A plan view of the post- <br />mining topography and correlated cross-sections are presented on Exhibits <br />F and B, respectively. <br /> <br />
