JIM TRTUM & RSSOCIRTES TEL~713-995-7191 <br />• <br />May 26, 1995 <br />Page 2 <br />RE: TATUM SUBSIDENCE <br />May 2~5 142 No.002 P.12 <br />/ Cj7 vvn -f ~ hn•, <br />-Flx~ ~ st ~-~ <br />dG -~~,~. <br />Mr. Thompson states in the January 7th letter that <br />"development mining", was underway ih 1988, 1990, and 1991. <br />The mine has testified that the mina was not sealed until <br />1992, and that excavation mining ceased in 1988, however Mr. <br />Thompson makes reference to development mining continuing in <br />1988, 1990, and ]991. What is wrong with this picture???? <br />The mine was a under a legal and moral obligation to <br />act prudently when they were placed on notice that our home <br />was displaying indications of subsidence in 1991. THEY <br />FAILED AND REFUSED TO TAKE ANY ACTION. Again, me dismissed <br />the possibility that the mine could be responsible Yor the <br />"cracks" solely because of the map provided by Thompson. <br />The subsidenc:c continues, and the State was placed on <br />notice that we were observing cracks in our home in October, <br />1992. Mr. Joseph Dudash, DMG, did an inspection on November <br />17, 1992, accompanied by Mr. Ossola, Las Animas County <br />Planner and Ron Thompson from the mine. Enclosed is a copy <br />of Mr. Dudash's report of tho investigation. Please note <br />that this report by the State makes reference to visible <br />cracks in our homy which appeared approximately 1. year <br />prior, and quoting Dudash's report "hairline cracks a year <br />ago are now 1/2 inch wide." That places the time the cracks <br />became visible when the mine was placed oh notice in <br />January, 1992. <br />The state was again placed on notice bf the subsidence <br />problem at our residence by Las Animas County Planner, <br />Michael Ossola on December 11, 1992, (copy attached) no <br />inspection resulted by the State. On March 25, 1993, we <br />provided the State with copies of photographs of our home <br />showing the subsidence, no investigation was done by the <br />state. <br />Exactly what mining, whether extraction or development <br />mining was done u,~der my Solitario property? why did the <br />mine deliberately omit advising us that the First North had <br />closed in 198a ;iecause of flooding? Was there mining <br />actually taking place AFTER 1988 as represented by the mine <br />in Mr. Thompson's January 7th letter? Why didn't the State <br />advise us of the location and condition of the mine under <br />our property in October, 1992, when the State was placed on <br />notice? <br />~/ The enclosed copies clearly dispel any doubt of the <br />o(C time period in which the subsidence began aEEeoting our <br />home.
