On January 7, 1992, Ron Thompson, with the mine
responded to our inquiry, (see attached) and he told .us..the.
"Development mining" had occurred in 1988, 1990, and, 1991,
and that Longwell mining had occurred from May - August of.
1991. Mr. Thompson included in his January, 7, 1992, letter .

mine progress up until May 11, 1998. THIS MAP DOES NOT, .
INDICATE THAT '1'f1E MINE HAD CROSSED UNDER THE RAIL ROAD
TRACKS ANp wA5 IN FACT CLOSE TO OUR HOME. We relied on this.
map as being an accurate depiction of the mine works. Th1s..
did not turn out to be an accurate oi- truthful
representation as to the location of the mine in relation to
our home in 1992.
Shortly after receipt of Mr. Thompsbn's January" 7th
letter, we sent him our misdated inquiry, dated December,
18, 1991, (copy attached). We acknowledged receipt of
Thompson's January 'Ith letter, and again advised the mine ..
that we were observing cracking in our home, we questioned
whether or not th9s cracking could be a result of the'mine;~..
as it appeared in the map provided by Mr. Thompson that the
mine was ON THE OTHER SIDE OF THE RAII,ROAD!1! The mine
deliberately provided us with an inaccurate map. The mine
made a false representation, upon -which we reliad,.:thus:'.: •:
committing a fraud. The mine was either interitiP.naliy ~ ;
misrepresenting the facts or was extremely negligent. .:.
