THIS MAP DOES NOT, . <br />INDICATE THAT '1'f1E MINE HAD CROSSED UNDER THE RAIL ROAD <br />TRACKS ANp wA5 IN FACT CLOSE TO OUR HOME. We relied on this. <br />map as being an accurate depiction of the mine works. Th1s.. <br />did not turn out to be an accurate oi- truthful <br />representation as to the location of the mine in relation to <br />our home in 1992. <br />Shortly after receipt of Mr. Thompsbn's January" 7th <br />letter, we sent him our misdated inquiry, dated December, <br />18, 1991, (copy attached). We acknowledged receipt of <br />Thompson's January 'Ith letter, and again advised the mine .. <br />that we were observing cracking in our home, we questioned <br />whether or not th9s cracking could be a result of the'mine;~.. <br />as it appeared in the map provided by Mr. Thompson that the <br />mine was ON THE OTHER SIDE OF THE RAII,ROAD!1! The mine <br />deliberately provided us with an inaccurate map. The mine <br />made a false representation, upon -which we reliad,.:thus:'.: •: <br />committing a fraud. The mine was either interitiP.naliy ~ ; <br />misrepresenting the facts or was extremely negligent. .:. <br />
