On November 13, 1992, Salt Creek Mining <br />Company submitted an application for a transfer and succession of operators. The permit was <br />transferred to Grand Valley Coal Company on Mazch 2, 1993. The permit was subsequently <br />transferred to Lodestar Energy, Inc. in August 1999, and most recently was transferred to Central <br />Appalachia Mining, LLC, through SO-3, finalized December 20, 2004. <br />Status of Previous Stipulations <br />Eleven stipulations (1,3, 5, 7, 12, 14, 15, 16, 17, 20, and 23) were attached to the previous <br />renewal permit (RN-3). Numerous stipulations previously attached to the permit, up to and <br />including Stipulation 25, had been resolved prior to RN-3 issuance. Stipulations 26 through 31 <br />were attached to the permit in association with revision actions approved subsequent to RN-3 <br />issuance. Stipulation 26 was attached to TR-13, Stipulations 27 and 28 were attached to TR-14, <br />and Stipulations 29, 30, and 31 were attached to TR-16. <br />Eight of the stipulations attached to RN-3 (1, 5, 14, 15, 16, 17, 20, and 23) apply to a haul road, <br />and additional or expanded mine facilities or mine plans that were never implemented and were <br />withdrawn from the permit by Technical Revision 16 (discussed below). These eight stipulations <br />aze therefore being terminated in association with this permit renewal (RN-4). Stipulations 3 and <br />7 apply to submittal of an annual hydrology report and fertility assessment/fertilizer application, <br />respectively. These stipulations aze terminated in association with this pemut renewal, due to <br />commitments the operator has incorporated into the permit application package. Stipulations 26 <br />through 3lhave previously been resolved and terminated (see discussion under individual <br />permitting actions below). <br />One stipulation that originated with a previous permitting action is retained, and is attached to the <br />Permit Renewal 4 (RN-4) proposed decision (Stipulation 12). One new stipulation (Stipulation <br />32) is also attached to the RN-4 proposed decision. <br />Summary of Permitting Actions <br />Permitting actions processed subsequent to the Division's August 28, 1995 mid-term review, and <br />prior to August 2000, aze addressed in the Division's August 10, 2000 mid-term review <br />document. The permit was most recently renewed on June 1, 1998 (RN-3), for a permit term that <br />expired January 13, 2003. The RN-3 permit contained stipulations that restricted mine <br />operations to current disturbed areas, and required revision of the permit prior to any further <br />disturbance or resumption of active status for purposes other than reclamation. Six technical <br />revisions (TR's), five minor revisions (MR's), and one permit transfer/succession of operator <br />(SO), have been processed since August 10, 2000, and aze described below. <br />TR-13 proposed approval decision was issued October 17, 2001. The revision incorporated <br />various updates and modifications in response to the Division's August 2000 mid-term permit <br />review. The revision allowed for a continuation of the temporary cessation status for the mine. <br />Worst case reclamation cost assessment resulted in a slight increase in the bond liability amount, <br />
