SECTION III -MIDTERM ADEQUACY QUESTIONS
<br />The permit was reviewed for compliance with the rules. Thirty-seven items were identified for
<br />revision. The Division requests that the permittee submit revised pages under appropriate
<br />revision applications to change the Permit Application Package (PAP) for thirty-four of these
<br />items, by January 18, 2006. Two items relate to groundwater points of compliance, currently
<br />being addressed at the Division. In addition, insertion of a compiled cost estimate (being
<br />developed by the Division) into the PAP will be appropriate.
<br />Item 1. Rule 2.03.5(3) Page 2.03-20 needs to be revised to list the last two violations issued
<br />on this permit. A previous violation, CV-2001-0041isted, could be deleted.
<br />Item 2. Rule 2.04.3(2)(a). Map 3a is not referenced in the text as apre-mining land use map.
<br />Please add Map 3a, to the current reference to Map 3, on page 2.04-2 of the PAP.
<br />Item 3. Rule 2.04.7(2). There aze two neazly identical pages in the Permit Application Package.
<br />Both pages were numbered 2.04-30, but one has a pen and ink change to read 2.04-29a. The text
<br />on page 2.04-30 with the 2.04-29a overstrike, a page annotated 05/06/04, appeazs to be more
<br />complete, but the last paragraph of the page 2.04-30, annotated 4/1/99, appeazs to still be valid.
<br />Please edit the duplication.
<br />Item 4. Edit. Please change "Volume 2A" to read "Volume IA" on page 2.05-15, line 6.
<br />Item 5. Edit. Please correct the reference to page 2.05-54(fj(40) on page 2,05-15, line 24.
<br />Item 6. Edit. Please change "cents" to read "centers" on page 2.05-16, line 44.
<br />Item 7. Edit. Please change "180°" (degrees) to read "180"' (feet) on page 2.05-17, line 48.
<br />Item 8. Rule 2.05.3(1). Production at the Foidel Creek Mine is in excess of 6,000,000 -
<br />10,000,000 tons of coal per year (see pages 2.05-8 and 2.05-9). However, there has been some
<br />indication that production is to increase to 12,000,000 tons per year. Please validate, or revise,
<br />the information in the PAP accordingly.
<br />Item 9. Rule 2.05.3(2)(6). Please update the areal extent information (22,247.2 acre permit
<br />area, 7,773 acres affected) on page 2.05-13, line 25. A permit azea of 22,580 acres, of which
<br />15,706 acres aze permitted to be affected, aze the figures in the current database of the Division.
<br />Item 10. Rule 2.05.3(2)(6). Please clarify the areal information provided on page 2.05-13,
<br />line 25, with the added acres of 7,689 at line 29 of page 2.05-16, the 2,482.6 acres at line 4 of
<br />page 2.05-17.2, and the 2,779.2 acres at line 23 of page 2.05-17.2.
<br />Item 11. Rule 2.05.3(2)(6). Please add, to Map 23, the station numbers (panels, mains and
<br />gateways) of the limit of mining in the current 5-year plan.
