-4- <br />a. The design submitted indicates that an 8-inch pipe will be fitted <br />with a gated outlet. The permittee needs to indicate at which end <br />of the pipe the gate will be located. <br />b. If the gate is to be normally closed, the permittee must indicate <br />that the emergency spillway design alone will pass the 25-year, <br />24-hour design flow at non-erosive velocities to comply with <br />4.05.6(3)(d). <br />c. If the gate is normally closed, the permittee should submit a <br />design calculation showing what opening in the gate will be <br />required to dewater the pond and still provide a minimum of <br />24-hours of detention time. <br />d. The response from the permittee on Stipulation No. 2 indicates that <br />the pipe will be located to dewater the pond below the maximum <br />sediment storage level. In order to comply with 4.05.6(3)(c), the <br />permittee should resubmit the design to indicate the dewatering <br />device will not be located at a lower elevation than the maximum <br />sediment storage volume. <br />e. In order to clarify the permittee's response to Stipulation No. 2 <br />as requested in 4 (a)-(d) above, all supporting calculations and <br />drawings should be included with the submittal consistent with <br />4.05.6(4). <br />5. The professional certification for the mine bench sediment pond (NPDES <br />discharge point No. 1) has not been submitted by the operator, although <br />quarterly pond inspection reports have been regularly received. The permittee <br />should submit this certification and supporting documentation as specified in <br />4.05.7. <br />6. The permittee should submit a current mine-workings map, as identified <br />under Stipulation No. 3 to Permit Revision No. 1, with the next submittal of <br />the annual mine inflow/outflow report. <br />III. SUMMARY OF REVISIONS <br />This section lists the revisions made subsequent to permit issuance.
