Mr. Jim Tatum -2- December 6, 1994 <br />our letter, indicating that a possible misidentification of the main residence (the ranch house) <br />had occurred. On August 12, 1993, we responded to the County, stating that after further <br />review, we had determined that the building identified on Basin Resources' Structure <br />Inventory Map as Structure No. 28, "Pink Adobe House," was in fact not the main residence <br />but the "bunkhouse." We further stated that the main residence (which happens to be a pink <br />adobe house, also) was identified by Basin Resources as Strncture No. 27, "Adobe House." <br />In addition to informing Las Animas County of this issue in our letter to them dated <br />August 12, 1993, we also informed them that the distance between the tench house and the <br />underground workings was 362.5 feet, based on this change. The Division also informed the <br />County that as room-and-pillar operations were limited to an extraction ratio of 50 percent, <br />the Division did not believe that any underground mine subsidence was occurring at the <br />Golden Eagle Mine in the area overlying the First North Main. A copy of the Division's <br />August 12, 1993 letter to Las Animas County was provided to your offices at that time. Our <br />August 12, 1993 letter was further referenced in a subsequent Division letter to your offices <br />dated October 13, 1993. <br />On December 9, 1993, the Division received Ten-Day Notice (TDN) No. X-93-020-370-005 <br />TV-3 from the U.S. Office of Surface Mining (OSM) in Albuquerque, New Mexico. This <br />TDN was delivered to the Division in response to a letter from your offices dated <br />November 18, 1993 to OSM regarding your concerns with the proximity of the underground <br />mining to the ranch house. <br />On December 20, 1993, the Division provided a response to their TDN. In this response, a <br />copy of a map identifying the ranch house, the limit of underground mining, and the map <br />scale were supplied. This map indicated to OSM that the ranch house was over 300 feet <br />from the furthest northern extent of the First North Main, corresponding to the 362.5-foot <br />figure in our August 13, 1993 letter to Las Animas County and your offices. A copy of the <br />Division's December 20, 1993 response to OSM is provided for your benefit. <br />In summary, the misunderstanding about which stricture was. the main ranch house was <br />cleared up. The OSM was given correct information. <br />2. "It is now undisputed, and a matter of testimony given under oath, that the airshaft bore-hole <br />was improperly cased and that the water running out the bottom of the bore-hole exceeds 20 <br />gallons per minute. It doesn't take a rocket scientist to see that a 12 to 14 foot bore-hole <br />leaking 20 gallons a minute could certainly damage a 4-inch bore-hole a few yards distant. <br />How does it happen that your agency never advised us of the faulty casing job, and the big <br />water leak when we were complaining about our water level being down below the pump <br />level in our well?" <br />The Division first became aware of a problem with the casing in airshaft NW-1 when it was <br />brought to our attention in your letter to us dated December 16, 1993. In that letter, we <br />were informed that Basin Resources had testified that the casing of the air shaft was <br />
