Hernandez. We have concluded our review of your letter, and provide the <br />following responses in the order of the items discussed in your letter. <br />1. "It appears that the report you furnished Surface Mining indicates that the underground <br />mining that approached our house never got closer than 600 to 700 feet. We now know that <br />this distance was considerably less than the distance reported to Surface Mining. Why was <br />not the fact of the matter related to Surface Mining." <br />Your statement that information was provided to the Office of Surface Mining by the <br />Division that indicated a distance of 600 to 700 feet between the Solitario ranch house and <br />the First North Main is incorrect. To address this, a short history of this matter should be <br />discussed. <br />The Division in June of 1993 received a letter from your offices dated May 25, 1993. This <br />letter discussed concerns with damage to your main residence (the ranch house) being <br />possibly related to underground mine subsidence. On July 7, 1993, the Division responded <br />to this letter, stating that room-and-pillar operations beneath the Purgatoire River were <br />limited by the Division to an extraction ratio of 50 percent to prevent subsidence, and, as <br />such, the Division did not believe the damage to the ranch house was mining related. <br />The Division further indicated in its July 7, 1993 letter to your offices that [he distance from <br />the ranch house to the First North Main was 750 feet. This distance was determined partly <br />from the photographs of the pink-stuccoed ranch house on the Solitario Ranch provided by <br />your offices to us earlier in 1993, and partly from the description of Structure No. 28 on <br />Basin Resources' Structure Inventory Map as the "Pink Adobe House." <br />A copy of the Division's July 7, 1993 letter to your offices was provided to the Las Anunas <br />County Planning and Land Use Office.
