We <br />requested a copy of this testimony in our letter to you dated December 29, 1993. We <br />received this information on January 24, 1994. <br />On January 18, 1994, OSM contacted the Division by telephone, asking for information <br />pertaining to the December 1993 Ten-Day Notice (TDN). This request was for information <br />in addition to information provided to OSM by the Division on December 20, 1993. <br />On February 8, 1994, the Division received notice from OSM that they had determined that <br />their issues raised in the TDN regarding the underground mine plans and the underground <br />mine subsidence monitoring were appropriately addressed by the Division. In this <br />February 8 notice, the OSM informed the Division that their concerns with possible impacts <br />to groundwater systems, however, were still unresolved. On February 14, 1994, the <br />Division responded to OSM's notice, requesting the issue be reviewed by OSM's <br />Washington, D. C. headquarters. On June 3, ]994, OSM-DC granted the Division until <br />July 25, 1994 to bring the matter to closure. <br />On April 20, 1994, Basin Resources wrote to your offices, proposing to lower the well pump <br />to below the existing water level in the well. In a letter dated April 28, 1994 from your <br />offices to Basin's attorneys, you stated, "If you think the well can be restored, I will be glad <br />to discuss it." <br />On July 12, 1994, the Division received a letter from your offices stating, "Mr. Joe Dudash <br />showed up here late yesterday and the bottom line is that it appears that the well we thought <br />was dry does have 40-plus feet of water in the borehole. It appears that the water level has <br />been lowered below the pump level, but the well is not dry...I plan on having the well pulled <br />and put into operation. It would appear at this point that the airshaft has not harmed the <br />well, unless the flow of water into the well bore has been decreased to the point the well will <br />not produce a usable quantity of water." <br />On July I8, 1994, the Division provided a copy of this letter to OSM, indicating [hat in <br />accordance with the letter from your offices, the issue addressed in the December 1993 TDN <br />regarding possible adverse impacts to groundwater systems had been resolved. This July 18, <br />1994 correspondence to OSM was within the timeframe allowed by OSM-DC in their May <br />26, 1994 letter to the Division. <br />3. "Our home, it appears that you want to try to place the blame on the structural shifts and <br />cracking anywhere but on mine-caused subsidence. Please respond to my inquiry promptly - <br />if you choose not to do so, I will issue a subpoena and question you under oath." <br />"a. Please state if you claim to have seen a leak anywhere in the boiler or heating system <br />piping. If so, state where you claim to have seen such a thing as all of the piping is <br />capable of being visually inspected so evidence of a leak is observable." <br />
