The permittee shall be responsible for any court and attorney fees if Routt County deems it <br />necessary to enforce any of the conditions of the SUP and is successful in such court action. <br />_ 7. No junk, trash or inoperative vehicles shall be stored or allowed to remain on the property. <br />8. Sanitary facilities are to be located. at the new~air intake shaft site during construction. <br />9. Routt County has the authority to close any County Road at their discretion if such road surface <br />is in poor condition and would be further damaged by additional use. <br />10. The SUP is valid for ten years from date of approval. - <br />11. This permit is contingent upon permits being obtained for highway and railroad access, air and <br />water emissions, reclamation and other permits from all involved agencies. <br />12. All haul roads and disturbed sites shall be watered or chemically stabilized to minimize dust. <br />Watering operations shall be increased immediately in response to periods of high wind. <br />13. A certificate of liability insurance for a minimum of 5600,000 shall be delivered to the Routt <br />County Planning Department prior to any activity on the site to cover any damages to public or <br />private properly. Routt County shall be named as an additional insured. <br />14. The permittee shall apply for and receive a Mined Land Reclamation Boazd permit and post a <br />reclamation bond with the MLRB prior to commencing any operations. The permittee shalt be <br />responsible for reclamation as set forth by the Colorado Mined Land Reclamation guidelines. <br />15. The SUP is contingent upon the petitioner complying with the applicable requirements of <br />Regulation III.D' of the Colorado Air Quality Control Commission, as a minimum 'standard, <br />with the following stipulations: <br />a.. The operator shall establish a State approved fugitive dust plan for the operation. <br />Periodic inspections by the County could then be used_to determine compliance with <br />the plan. The State opacity limit of 20% should be incorporated as a requirement of <br />the permit. Violations of compliance with this standazd will be documented by a <br />certified opacity reader. <br />b. The dust control plan shall be formulated by the petitioner in cooperation with the <br />Planning staff, then forwarded to the Colorado Air Quality Control Division for final <br />approval, and is subject to control and administration by Routt County Planning <br />Department staff or Routt County Environmental Health staff. <br />c. The dust control plan can be amended by Planning Commission and the Board of <br />County Commissioners, if necessary. <br />d. The dust control plan shall address site-specific issues of concern, such as the <br />topsoil stockpiles and wind breaking, The slope of the stockpiles shall be contdured <br />to a'slope conducive to vegetative cover and revegetated within 6 months or the next <br />growing season. Wind breaking shall occur as necessary by placement of stockpiles <br />or other material in a manner so as to prevent blowing of material from. such piles. <br />This condition will apply to stockpiles and any berms that maybe developed. <br />e. Revegetation of all disturbed areas will occur within 6 months or by the next <br />growing season, whichever is sooner. <br />16. The operator shall comply with all applicable standazds set forth by the Colorado Department of <br />Health and the Routt County Department of Environmental Health.
