Review of Terms & Conditions, Dowe Flats Special Use Permit <br />LREP, Inc. October, 2004 <br />Page 3 of 6 <br />Any post-mining development of the property is subject to land use regulations at the time <br />of development. <br />Comments: Land use within the permit area owned by Cemex is primazily mining and <br />reclamation, including the mine operations center, crusher, and conveyor corridor. <br />Secondarily, the Dowe Flats Estates subdivision exemption approval provides for <br />rural residential development after mining. However, assuming Boulder County <br />exercises its options to purchase Cemex's remaining eleven Dowe Flats <br />development rights (and consequently the 153 acres of land associated with the <br />Dowe Flats Estates subdivision exemption approval), this land use will not be <br />implemented. <br />6. Perimeter of mine operation shall be visibly marked. <br />' Comments: The east and south mining boundary is County Road 47. The west boundary has <br />been monumented with a series of cement benchmazks and 14" diameter posts, and <br />are visible on the enclosed aerial photograph. The mine is still more than 0.5 mile <br />south of the north boundary. GPS coordinates for the benchmazks have been taken <br />and aze being submitted to the county. <br /> <br />~ , <br />Annual reports to County addressing: <br />o mining and reclamation progress <br />o monitoring studies <br />o raptor studies for 5 years <br />o cultural resources <br />Comments: Annual mining and reclamation reports submitted to the Colorado Mined Land <br />Reclamation Boazd, Division of Minerals and Geology are included in Appendix B. <br />This appendix also contains a Reclamation Monitoring Plan for review by county <br />staff that is proposed for future use and creates specific monitoring protocols which <br />are currently lacking in the review process. Monitoring studies and the Dowe Flats <br />winter raptor study have been completed. Monitoring reports for buried cultural <br />resources during ground disturbance for the sequential opening of the mine pit aze <br />included in Appendix C. <br />8. Monitoring and mitigation for the Montgomery School. <br />Comments: A pre-blast survey for the Montgomery School (Michael Weston residence) was <br />completed in 1995. Annual monitoring by a qualified historic resources consultant <br />took place from 1995-2000, with no reports of adverse impacts. Monitoring has <br />since ceased because mine activities have moved to the north, and continue to move <br />away from the Montgomery School. Seismic monitoring at the City of Longmont <br />
