Coal Processing Waste and Non-Coal Processing Waste - Rules <br />an <br />The only change in this section from the Permit Revision No. 1 Findings <br />is that WFC will be placing four feet of non-toxic cover on the waste <br />pile. They had intended to seek variance from the 4 foot requirement but <br />have since reconsidered this proposal. Therefore stipulation 27 is no <br />longer required. <br />Although not actively used at this time, the operator has approval to <br />place underground development waste on pile located on the Purgatoire <br />River alluvial valley floor. However, the permit application does not <br />show that the drainage has been designed to safely pass the 100-year, <br />24-hour event. Therefore, the following stipulation is imposed. <br />Stipulation No. 44 <br />WITHIN 60 DAYS OF PERMIT ISSUANCE THE OPERATIOJJ MUS7 SUBMIT DESIGNS FOR <br />THE OLD REFUSE PILE DRAINAGE THAT WILL SAFELY PASS THE 100-YEAR, 24-HOUR <br />EVENT. ANY REQUIRED ON-THE-GROUND CHANGES TO THE DRAINAGE MUST BE MADE <br />WITHIN 90 DAYS OF PERMIT ISSUANCE. <br />With the acceptance of this stipulation, the operation is in compliance <br />with the requirements of this section. <br />XVIII. Mine Facilities, Coal Handling Structures; Support Facilities - <br />es <br />Some additional support facilities have been added to the list of mine <br />facilities since permit revision No. 1. The first is a septic leach <br />field north of the office facilities per Minor Revision 7 (MR-07) and a <br />sewage treatment facility per Technical Revision 10 (TR-10). A permanent <br />non-coal waste disposal area (MR-OS) and a temporary conveyor system <br />(MR-09) were also added. The conveyor has since been removed. A truck <br />parking and refueling area was also added (MR-14) to facilitate the <br />trucks used in transporting coal from the Golden Eagle Mine. The access <br />road and beltline in the RDA have both been extended (MR-16). The <br />approved rail dump has not yet been constructed. With these additions <br />the proposed operation is in compliance with the requirements of this <br />section. <br />XIX. Roads = Rules 2.05.3(3)(c)(i) and 4:03 <br />A variety of changes involving the roads at the New Elk Mine has occurred <br />since the mid-term review. Maps 11 and 12 in the application contain the <br />most recent designations of roads on the disturbed area. These maps were <br />both revised in 1988 with Map 11 being updated during the renewal process. <br />Stipulation 28 requiring various calculations and map updating has been <br />satisfied. Stipulation 29 has not been satisfied and is repeated here. <br />-33- <br />
