<br />Stipulation No. 29 <br /> <br />THE PERMITTEE MUST SUBMIT, AS A REVISION, A RECLAMATION PLAN FOR ROADS AT <br />THE ALLEN MINE THAT MEETS THE REQUIREMENTS OF RULES 4.03.2(7) AND <br />4.03,3(7) WITHIN 12 MONTHS OF PERMIT ISSUANCE. <br />In addition two stipulations from Permit Revision #1 have been <br />satisfied. Stipulation No. 12 requiring installational culverts and <br />ditch sizing updates has been satisfied... Stipulation No. 13 is no longer <br />needed since the road in question was not installed. Also Technical <br />Revision 9 contained one stipulation (No. 1(51)) which requested an <br />updated map 11 and has also been satisfied. <br />With satisfactory resolution of the above stipulation, the proposed <br />operation will be in compliance with the requirements of this section. <br />XX. Bonding = Rule 2.05,4(2)(b) <br />During the renewal process, a comprehensive review of the present bond <br />was performed. It was discovered that the New Elk Mine was underbonded <br />by $448,205,00. The majority of the discrepency occurred because of the <br />manner in which demolition of buildings was calculated (Ft2 vs, Ft3) <br />and general inflation. These calculations can be found in Exhibit 28 in <br />the permit application. The bond necessary for the start of this five <br />year permit term will therefore be E2,450,000.00. <br />To insure that the bond will be on file with the Division before final <br />approval is granted the following stipulation is necessary, <br />Stipulation No: 43 <br />THE OPERATOR WILL AMEND THE PRESENT BOND FROM $2,001,795.00 TO <br />$2,450,000.00 TO REFLECT THE DISCREPANCIES DISCOVERED DURING THE RENEWAL <br />PROCESS. THE NEW BOND WILL BE IN PLACE BEFORE JANUARY 25, 1989 OR FINAL <br />APPROVAL WILL NOT BE GRANTED. <br />Upon satisfying the above stipulation the operation will be in compliance <br />with the requirements of this section. <br />XXI. Subsidence-- Rules 2.05.6(6) and 4,20 <br />Stipulation 30 requiring pillar stability calculations has been satisfied, <br />No other change has occurred in this area; therefore the Division finds <br />the operation in compliance with the requirements of this section. <br />XXII, Special Categories of P4ining-= Rules 2.06, 4,22, 4.23, 4.26, 4.27, <br />an <br />The requirements of this section do not apply to this operation, since <br />none of the special categories of mining will be conducted. <br />-34- <br />
