Stipulation No. 29

THE PERMITTEE MUST SUBMIT, AS A REVISION, A RECLAMATION PLAN FOR ROADS AT
THE ALLEN MINE THAT MEETS THE REQUIREMENTS OF RULES 4.03.2(7) AND
4.03,3(7) WITHIN 12 MONTHS OF PERMIT ISSUANCE.
In addition two stipulations from Permit Revision #1 have been
satisfied. Stipulation No. 12 requiring installational culverts and
ditch sizing updates has been satisfied... Stipulation No. 13 is no longer
needed since the road in question was not installed. Also Technical
Revision 9 contained one stipulation (No. 1(51)) which requested an
updated map 11 and has also been satisfied.
With satisfactory resolution of the above stipulation, the proposed
operation will be in compliance with the requirements of this section.
XX. Bonding = Rule 2.05,4(2)(b)
During the renewal process, a comprehensive review of the present bond
was performed. It was discovered that the New Elk Mine was underbonded
by $448,205,00. The majority of the discrepency occurred because of the
manner in which demolition of buildings was calculated (Ft2 vs, Ft3)
and general inflation. These calculations can be found in Exhibit 28 in
the permit application. The bond necessary for the start of this five
year permit term will therefore be E2,450,000.00.
To insure that the bond will be on file with the Division before final
approval is granted the following stipulation is necessary,
Stipulation No: 43
THE OPERATOR WILL AMEND THE PRESENT BOND FROM $2,001,795.00 TO
$2,450,000.00 TO REFLECT THE DISCREPANCIES DISCOVERED DURING THE RENEWAL
PROCESS. THE NEW BOND WILL BE IN PLACE BEFORE JANUARY 25, 1989 OR FINAL
APPROVAL WILL NOT BE GRANTED.
Upon satisfying the above stipulation the operation will be in compliance
with the requirements of this section.
XXI. Subsidence-- Rules 2.05.6(6) and 4,20
Stipulation 30 requiring pillar stability calculations has been satisfied,
No other change has occurred in this area; therefore the Division finds
the operation in compliance with the requirements of this section.
XXII, Special Categories of P4ining-= Rules 2.06, 4,22, 4.23, 4.26, 4.27,
an
The requirements of this section do not apply to this operation, since
none of the special categories of mining will be conducted.
-34-
