<br />Stipulation 23 provided for various seeding requirements and has been <br />satisfied. Stipulation 24 pertained to reclamation and revegetation of <br />the Willow Carr riparian area and has been satisfied. Stipulation 25 <br />required a revegetation monitoring plan and has been satisfied. <br />Two stipulations from the Permit Revision iil findings have also been <br />satisfied. Stipulation No. 10 regarding sampling methodologies and <br />stipulation No. 11 regarding reference areas, both in the RDA, have been <br />adequately addressed in the permit application and are satisfied. <br />With the above changes in the permit application the operations is in <br />compliance with the requirements of this sections. <br />XII, Fish and Wildlife - Rules 2,04.11; 2.05.6(2) and 4.18 <br />No change is required to this section of the findings and the operation <br />is in compliance with the requirements of this section. <br />XIII. Prime Farmland-='Rules 2:04.12 ; 2.06.6 and 4.25 <br />The applicant has supplied documentation from the Soil Conservation <br />Service (USDA) stating that there are no prime farmlands in the vicinity <br />of the mine. This documentation was supplied in the permanent program <br />permit application. <br />Pursuant to 2.07.6(2)(k) and on the basis of documentation provided by <br />the applicant, the Division has determined that no prime farmlands exist <br />within the permit area. <br />XIV. Operations Description ='Rules 2:05:2; 2.05.30; 2.05.3(2), and 4.01 <br />All previously approved operations on the surface and underground will <br />remain unchanged through the removal term. The total surface disturbance <br />during the renewal teen will bE 153 acres. <br />The operation is in compliance with the requirements of this section. <br />XV. Explosives - Rules 2.05:(6) and 4:08 <br />In general, the requirements of this section do not apply to this <br />operation. However, explosives were used temporarily, per approval of <br />I+linor Revision -05, to obtain rock for the RDA underdrain. Two <br />stipulations (47 and 48) pertaining to this revision are no longer <br />needed. This practice is no longer occurring and the operation is in <br />compliance with the requirements of this section. <br />XVI. Backfilling and Grading = Rules-2:05.3(9); 2.05.4(2)(a); 2.05.4(2)(c), <br />an <br />Stipulation 26 requiring more specific detail in the backfilling and <br />grading plan has been satisfied. <br />IJo changes are required to this section of the findings. <br />-3 2- <br />
