<br /> <br />The staff gages required by Stipulation No. 5 have been installed at pond <br />007. Pond 006 no longer functions for sediment control so a staff gage <br />is not required for sediment levels. The stipulation is satisfied. <br />Technical revision 10 contained a stipulation (No. 1 (50)) requiring a <br />new NPDES permit and has been satisfied. <br />Stipulation No. 6 required submittal <br />sediment ponds. Two stipulations <br />were attached (41(53) and 42(54)) and have been satisfied. Minor <br />Revision 15 was a follow-up to the change in drainage plan and included <br />changes to Tables 21 and 22 and Maps 13 and 14. It was approved <br />September 19, 1988. Due to those revisions a clearly defined drainage <br />system is now in place at the New Elk Mine. One other change to be noted <br />is that Pond 007 now controls surface flow formerly controlled by Pond <br />006. <br />Technical Revision 14 contained one stipulation (42(56)) which called for <br />reclaiming a ditch and removing a culvert from service and has been <br />satisfied. <br />Also Minor Revision 14 contained one stipulation (41(55)) which required <br />that runoff from a parking area be directed through sediment control <br />structures. This stipulation has been satisfied. <br />With the above changes noted the proposed operation is in compliance with <br />this section. <br />VI. Hydrologic Balance: Ground Water - Rules 2.04.5, 2.04.7, 2.05.3(4), <br />an <br />The description of the ground water in both the original Findings and in <br />the Permit Revision No. 1 Findings remain valid for the mine. However, <br />the status of stipulations is detailed below. <br />The original Findings document imposed Stipulations 7, 8, and 9 on the <br />ground water portion of the permit. These stipulations dealt with <br />requirements for monitoring and mapping of springs and seeps in the <br />vicinity of the mine. Stipulation 7 and 8 were both satisfied. <br />Stipulation No. 9 was satisfied as originally written but there are still <br />requirements for annual monitoring from the Stipulation. Therefore, <br />revised Stipulation 9A follows: <br />Stipulation No: 9A. <br />THE OPERATOR WILL CONTINUE TO MONITOR THE SPRINGS NUMBERED 12 THRU 20 IN <br />AUGUST OF EACH YEAR AND SUBMIT AN ASSESSMENT OF THE SIGNIFICANCE OF THE <br />SPRINGS AND SEEPS ON SURFACE FLOWS, IRRIGATION PRACTICES, LIVESTOCK <br />WATERING, WILDLIFE WATERING, AND DOP1ESTIC USE. THIS INFORMATION WILL BE <br />SUBMITTED WITH THE ANNUAL HYDROLOGIC REPORT. <br />-9- <br />
