A LONGITUDINAL PROFILE OF THE STREAM BED FROM 50 FEET <br />ABOVE THE BRIDGE CROSSING THE PURGATOIRE RIVER, <br />EXTENDING TO 100 FEET BELOW THE STREAM RELOCATION <br />SECTION. <br />3. A MONUMENT TO BE PLACED ON THE NORTH BANK OF THE <br />RELOCATED PURGATOIRE RIVER IN THE STRAIGHT PORTION OF <br />THE CHANNEL RELOCATION FOR THE PURPOSE OF MEASURING BANK <br />MOVEMENT. THIS MONUMENT MUST BE PLACED IN AN AREA WHERE <br />NO FUTURE DISTURBANCE WILL OCCUR. <br />The current approved monitoring plan for both surface and ground water <br />_~ was approved on September 4, 1985 as Technical Revision No. 2. This plan <br />covers both the New Elk and the Golden Eagle t4ines. <br />After the relocation of the Purgatoire River, the surface disturbance was <br />still within 100 feet of this perennial stream. Under Rule 4.05.18, the <br />Division granted a variance from the 100 foot stream buffer zone based on <br />the following findings: <br />a. The relocated stream channel will not be disturbed by the operation; <br />b. The operator has committed to berms to route all water draining <br />from areas of surface disturbance away from the stream to sediment <br />ponds. Therefore, the water quality and quantity of the stream <br />within 100 feet of the surface operation will not be adversely <br />affected, and; <br />c. No riparian vegetation exists in the stream channel. The operator <br />has committed to a re vegetation plan for all surface disturbance in <br />the buffer zone. <br />The original Findings document also contained numerous stipulations to <br />the surface water section. The status of these stipulations are detailed <br />below. <br />A study of the mass water usage at the mine and discharge back to the <br />hydrologic system was required by Stipulation No. 1. This information <br />has been submitted and the stipulation is no longer in effect. The <br />placement of stream buffer signs was required by Stipulation No. 2. The <br />signs have been placed as required, so the stipulation is satisfied. <br />Stipulation No. 3 required certification by a registered professional <br />engineer that the four sediment ponds are constructed as designed. Ponds <br />006 and 007 have since been redesigned to allow 006 to serve as a slurry <br />pond with all its original drainage area directed to 007. All four ponds <br />have been certified "as built" so Stipulation No. 3 is no longer in <br />effect. <br />Stipulation No. 4 has been resolved by the Division granting a small area <br />exemption from sediment control for much of the west portal area. The <br />stipulation is satisfied. <br />-8- <br />
