Hydrologic Balance: Surface Water - Rules 2.04.5, 2.04.7, 2.05.3(4) <br />.Ub.bl31 a <br />The status of the Permit Revision No. 1 Stipulation pertaining to surface <br />water are detailed below. <br />Stipulation No. 1 dealt with final Division approval prior to beginning <br />construction of the refuse area sediment pond. This stipulation has been <br />satisfied. Part A of Stipulation No. 2 dealt with a previously approved <br />design for multi level dewatering devices. This combination spillway was <br />not allowed by MSHA. Part B of Stipulation No. 2 required quarterly <br />monitoring of the dam for stability. This is covered in the Colorado <br />Rules and Regulations and does not require a stipulation to the permit. <br />Stipulation No. 2 is no longer in effect. <br />Additional monitoring requirements were required by Stipulation No. 3. <br />The operator h s committed to this monitoring as detailed in Table 27, <br />page 2 of the permit renewal application so the stipulation is no <br />Ob L~-anger requi red. <br />2,oS Stipulation No. 4 required testing of the riprap material prior to <br />placement in the diverted area of the Purgatoire River. This requirement <br />was satisfied. Stipulation No. 5 dealt with diverting of the low-flow of <br />the Purgatoire during the construction. This stipulation was also <br />satisfied. <br />Stipulation No. 6 required placement of stream buffer zone signs on the <br />Purgatoire River following completion of relocation. This requirement <br />has been satisfied. <br />Technical Revision No. 1 contained two stipulations relating to the <br />Purgatoire River Diversion. Stipulation 1 (45) called for maintenance of <br />a temporary sediment structure and is no longer in effect. Stipulation <br />No. 2 (46) requires an annual survey of the diversion and is still in <br />effect. <br />STIPULATION N0. 2(46) <br />IMMEDIATELY FOLLOWING SRTEAM CHANNEL RELOCATION CONSTRUCTION AND <br />BEFORE REROUTING THE PURGATOIRE BACK INTO ITS PERMANENT BANKS, <br />WYOMING FUELS COMPANY MUST COMPLETE A SURVEY OF THE NEWLY <br />CONSTRUCTED CHAtJNEL. THE COMPONENTS OF THE SURVEY ARE DETAILED <br />BELOW. <br />EACH FOLLOWING YEAR, DURING THE MONTH OF FEBRUARY (COINCIDING WITH <br />LOW-FLOW), WYOMING FUELS MUST RESURVEY ALL OF THE FOLLOWING <br />REQUIRED COMPONENTS OF THE CHANNEL AND SUBMIT THIS INFORMATION TO <br />THE DIVISION BY MAY 1ST OF EACH YEAR. <br />1. FIVE CROSS-SECTIONAL SURVEYS OF THE STREAM RELOCATION, <br />TO BE AGREED UPON BY THE DIVISION PRIOR TO THE SURVEY. <br />-7- <br />
