(c) Hall-Irwin Construction Co., in its application for Substitute Supply Plan stated that the maximum exposed ground water would be 3.72 acres. (d) Hall-Irwin, in its application for Substitute Supply Plan stated Booth Land and Livestock Company owned two imgation wells within 600 feet of the proposed gravel pit, which appears to be correct. (e) No Substitute Supply Plan has been approved. (~ No Gravel Pit Well Permit has been granted. (g) Hall-Irwin Construction Co. in an Amended Mining Permit application with the Division of Minerals and Geology stated that the State Engineer's Office had issued a Gravel Permit Well Permit and Mr. Gregg of Hall-Irwin Construction Co. appazently represented to Thomas A. Schreiner, an inspector with the Division of Minerals and Geology that Hall-Irwin Construction Company had an approved Well Permit and Temporary Substitute Supply Plan from the State Engineer's Office. Please be advised: 1. Contrary to the representations in the application for Substitute Supply Plan, the exposed ground water from the mining operation exceeds an estimated 20 acres. Enclosed is an aerial photograph taken on June 15, 2003 which is scaled to approximately 150 feet equals one inch. The aerial photograph reveals a gravel pit and a wash or settling pond with exposed surface water estimated to be 22 acres. Additionally, in the southwest comer of the property is a sit basin which contains some surface water with an estimated azea of 10 acres other mined areas. Other mused areas also contain exposed ground water. 2. BLC Development, LLC has not signed a We115pacing Consent Statement and will not sign a Well Spacing Consent Statement without protective conditions and affirmative covenants from Hall-Irwin Construction Co. 3. Hall-Irwin Construction Co. is commencing expanded gravel mining operations exceeding what appears to be the 40 acres of the original Gravel Mind Well Permit, without the authorization and consent of BLC Development, LLC, which is required for expanded mining operations and has exposed additional ground water without applying for an additional Gravel Pit Water Permit application.
