The mining operation of Hall-Irwin Construction Co. on the BLC Development, <br />LLC property has for more than two yeazs been in violation of C.R.S. 37-90-136(11)(a) and the <br />regulations of the Division of Minerals and Geology. The more recent expanded mining <br />operafion appeazs to have been commenced without even malting application for a Gravel Pit <br />Well Permit. <br />5. The copy of the June 15, 2003 aerial photograph identifies the surface water <br />azeas, the area of pemutted mining, the area ofnon-permitted mining and the expanded current <br />mining operations. <br />BLC Development, LLC trusts that the Office of the State Engineer will take such action <br />as is prescribed and compelled bylaw.
