Gentlemen:
BLC Development, LLC is the owner of the following described property to wit:
E%z of the SE'/o, Section 2
SE%< of the NE'/<, Section 2
SW`/a of the NW'ta, Section 1
S%z (approximately) of the SE% of the NW%<, Section 1
SW'/a of the NE'/a, Section 1
E%z of the SE'/4 of the NE%4, Section 1
SW'/4 (except for approximately 42 acres in the SE comer), Section
all in Township, 2N, Range 68W of the 6`~' P.M., Weld County, Colorado
Hall-Irwin Construction Company is operating a gravel none on the southwesterly part of
the above-described property. This gravel mine has been operating for at least two yeazs.
A search of the permit files in the State Engineer's Office reveals:
(a) Hall-Irwin Construction Co. has not applied for a Gravel Pit Well PermiYon the BLC
Development, LLC property above-described on which gravel mining has continued for at least
two yeazs.
(b) Hall-Irwin did file a Gravel Pit Well Permit application on July 17, 1998 fora 40 .
acre gravel mine, but the location of the gravel mine was described as the NW'/a of the SW %<,
Section 2, Township 2N, Range b8W of the 6`1i P.M., which property is at least `/z of a mile west
of the BLC Development, LLC property (appazently Hall-Irvin Construction Co. intended the
