WITHIN 6 MONTHS OF PERMIT ISSUANCE, THE PERMITTEE WILL SUBMIT A <br />CONTINGENCY PLAN TO BE IMPLEMENTED IN THE EVENT THE ROADS ARE NOT <br />JUDGED SUFFICIENTLY STABLE OR OF SUFFICIENTLY LOW MAINTENANCE <br />REQUIREMENT TO BE SUITABLE FOR THE POST-MINING LAND USE. <br />With the acceptance of the two stipulations above, the proposed operation is <br />in compliance with the requirements of this section. <br />XX. Bonding - Rule 2.05.7(2)(b) and Rule 3 <br />Reclamation cost calculations are provided on pages IV-3 through IV-4 of the <br />application, and in the applicant's adequacy responses of March 26, 1984. The <br />calculations have been substantially revised by the Division (see memo dated <br />May 8, 1984). The bond amount required is $685,000.00. <br />Stipulation No. 13: <br />BOND IN THE AMOUNT OF $685,000.00 MUST BE SUBMITTED TO THE DIVISION <br />WITHIN 30 DAYS OF PUBLICATION OF THE PROPOSED DECISION. THE PERMIT <br />WILL NOT BE ISSUED UNTIL AN ACCEPTABLE BOND HAS BEEN SUBMITTED. <br />With the acceptance of the above stipulation the applicant is in compliance <br />with the requirements of this section. <br />XXI. Sealing of Drilled Holes and Underground Openings - Rules <br />Sealing of drill holes is described on Page IV-16. The majority of holes <br />drilled have been previously or will be mined through during this permit <br />term. No additional drilling is anticipated this permit term, with the <br />exception of monitoring wells drilled in the backfilled spoils. <br />The proposed operation is in compliance with the requirements of this section. <br />XXII. S ecial Cate ories of Minin other than AVF and Prime Farmland - <br />u es 2.06. 4.22. 4.23. 4.26. 4.27. 4.28. and 4.29 <br />The Grassy Gap operation does not involve any special categories of mining as <br />described in Rule 2.06. Originally the application proposed a limited amount <br />of auger mining, but the mine plan has since been revised and the auger mining <br />proposal has been deleted. <br />The proposed operation is in compliance with the requirements of this section. <br />XXIII. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4 <br />4.28 an 4.30 <br />The operation is in compliance with the applicable requirements of this <br />section. The operation does not involve surface mining near underground <br />mining. <br />
